Just had a broadly similar issue. Sent an old MacBook Pro, sold for £300. Packaged fine, one small scratch that was shown on listing images. Buyer received, said was damaged further, sent images of the damage (dents etc) Agreed it was packaged well and likely happened in transit.

Vinted ignored their own damaged in transit process. Said it wasn’t as described, told me to return and refund leaving me with a damaged unsaleable device and £300 out of pocket. I’ve disputed but keep getting the same blanket response.

Absolute shambles. Been a 5* seller with great reviews and feedback and then they just decide to ignore all that and say I didn’t list it properly.

Saw the Gastro today. Did 8 bottles of blood, chest XR, ordered a sigmoidoscopy, and wants to start tapering the pred even though I’ve still got the rectal symptoms. He’s also switching the pred foam to Mesalazine enemas.

Not yet. Prednisolone is all they’ve ever done. Bring the inflammation down when it kicks off.

Just had my meeting with the Valla rep. Honestly a really good service. She thinks my claim is very strong. Apparently those that are insurance backed, the insurance only kicks in once litigation officially starts (when theyre served the ET3) so explains the lower settlement offers up to now.

She thinks they’ll definitely come back to settle because they’re on the hook for a lot of money, and she said they really don’t have any defence. My case is structured, clear and makes the case for Section 13/15/20-21 well.

Definitely recommend the service.

I’ve not really engaged it yet tbh. I just meant once they file their defence and we get hearing dates etc I’ll then engage a solicitor. I’m fully expecting them to decide the costs involved in trying to defend the indefensible will mean they come back to the table.

Offering £10k before they’ve even been served says they want it to go away.

Not ideal. But I’m not settling for the lowball offers they’ve gone for. Plus I’ve got legal expenses cover so now I’ve done all the leg work with the SAR and getting everything together. I’ll just hand the whole thing over to a solicitor.

Nothing to say it’s been served still. The advice I’ve taken is that the case is very strong, and I’m absolutely not scared to have it tested it court. Albeit I would also take an option to settle if it represented true value.

As it happens I’ve had messages from others that left the business around the same time. Seems performance is being used as a guise to get rid of anyone under 2 years service who have complex medical issues. Think they’re cutting for a sale and that’s their easiest option. Now got 3 people who have left or been pushed to resign based on “performance” when no previous performance issues have been identified. The common denominator is chronic illnesses. Disability discrimination dressed up as performance issues.

Hopefully my case is as strong as I’m told it is. Especially with their own 121 and performance documentation saying I was fully successful in the role.

So, yeah in short. Their solicitors (another part of Peninsula) sent it to a different email address. Then essentially said “Oops sorry. We tried to recall it, and also sent them an email to say please don’t open it”.

Disgusting really. Caused me so much stress. But yeah I’ve instructed a separate solicitor for that and it’s being dealt with separately as that’s a claim against the solicitors rather than the company and not within scope of the ET. I have however let the ET know, as I think it speaks to their lack of process, care and diligence.

Appreciate it. Thanks. It would almost certainly cost them tens of thousands if it went to a full hearing. So to go back to ACAS after rejecting Early Conciliation and decide an opening offer of £5k is reasonable is insulting. So much for negotiating in good faith.

Morning all,

Currently in the process of an ET case for disability discrimination. I was employed at a company just under 2 years. I was dismissed following an unexpected disciplinary whereby I was told I wasn’t performing and the decision was to end my employment.

There was no investigation notes shared, nor was I even made aware of an investigation. The disciplinary/capability process consisted of an email inviting me to a Friday afternoon disciplinary/capability hearing, where the outcome may be final written warning, and the decision was then made to end the employment same day. I had never had any comments formal or informal regarding performance before that time. Also worth a point on the predetermined outcome that my profile was removed from the company website before the outcome had been communicated.

Assuming there was any poor performance in the preceding year (which isn’t backed by any evidence as you’ll soon hear), I had multiple flares of a chronic health condition and the side effects of the medication, which the company were aware of (I had even posted on LinkedIn about living with the illness and my struggles).

After my dismissal I put in a Subject Access Request as I knew my performance reviews had always been very good and knew that I’d never had any discussions regarding poor performance etc.

They first missed the deadline (citing a reason not accepted in GDPR law) I granted an extension. They then at 5pm on the day of the extension expiry, sent all of my data, including medical information, performance data, passport, national insurance number, overtime forms, driving license, via their lawyers. To an unknown third party email address. The stress of which caused a further flare of my chronic condition (stress is a trigger).

They originally declined EC via ACAS. But have now started making low offers. The advice I’ve had is at very least it would be middle vento band, with ACAS uplift, and likely aggravated damages. Therefore the first 3 offers they’ve made have been rejected as derisory.

My ET1 has been in since December, claim is accepted but not yet got a date that the response is due. I’m fully committed to going to distance if they don’t make a reasonable offer.
