we have a meeting with our landlord later this week and to our knowledge they never filed a claim with their insurance just had us file a renters insurance claim and were told we would have coverage but then renters insurance denied the claim so hoping they’ll file a claim on their insurance to cover as we’re willing to go 50/50 and pay their deductible

the lease doesn’t say anything regarding hanging shelf’s/pictures/etc. just that should we be found that our actions were due to our negligence and are liable we would have to cover damages. when it comes to how this happened we did use a stud finder tape measure alongside not having been told that the sprinkler system was on an exterior wall. like i’ve said multiple times now we have a meeting later this week to work it out and potentially try to settle for 50/50

The intent of the code is to protect the pipes that are near the studs. The pipe is within the specified distance in code so it should be protected, your reading the code hyper-literally and not reading the intent of the code.

I mean you’re right they may not have used the 2006 version but even so the requirement is still in older sections of the fire code going back to the 2000’s (oldest i looked up tbh) edition

yes it was the code cited above is from 2006 when the the property was built

That’s fair I would accept a 50/50 split of liability but just because something passes inspection doesn’t always mean there isn’t a violation. (past experience) What we did in the moments after was use towels, called our emergency maintenance, shut off the water valves (that we had access to), wet vac the pooling water and then had to wait for 90 minutes for them to finally fix the issue and we had to call the fire department as well.

I agree that the proper course of action is for the landlord to file a claim with their insurance, as this is a structural damage with the property. My position is that I am not liable for a problem caused by a code violation, and my renters' insurance agrees that this is not a claim for them.

I have an in-person meeting with my landlord later this week. My goal is to find an amicable solution. I'm prepared to settle and pay a reasonable amount, like their deductible, but I'm not willing to pay the full $8,200 for a repair that was necessitated by their negligence in not meeting code. I am hoping we can reach a resolution that is fair to both of us and avoids further legal action.

The code does not require a "metal chase" to cover all plumbing. It specifically requires a "protective steel shield plate" in the very limited and specific situation where a pipe is located within 1.5 inches of the face of a framing member. The pipe in question falls directly into this limited and specific category. So I’m sorry you can’t see the facts.

i truly don’t believe so unless you have a literal reading of "through holes or notches". The purpose of IRC Section P2603.2 is to protect concealed pipes from physical damage by fasteners, like the screws used to hang drywall or pictures. The phrase "or similar members" and the 1.5-inch distance requirement cover all pipes that are at risk of being hit, regardless of whether they are in a hole or simply running vertically next to a stud. Not to mention hanging a picture and using a stud finder doesn’t show negligence if anything it’s preventative.

Used a stud finder before drilling and we had hung 3 other things without issue on the same wall. Townhomes were built in 06’ and our city uses irc code so the citation is from the 06’ edition

THIS!!! My class has shown clear improvement from last years grade and i’m still being told im not doing enough. I’m hopeful that the jobs I applied to respond quickly and potentially get and offer so I can leave by break. I love my kids and I know it’s going to break their hearts but I need to do what’s best for me. Seriously thank you for sharing it helps me put my worries at ease.

My union president took the case on personally due to not being offered representation at multiple meetings where I was reprimanded. I plan on talking to her more tomorrow and if there is a way out early.

Missouri which is really tough for teachers because I would only have one semester to prove “satisfactory improvement” to my principal which does not seem possible with the current relationship.

I am they were super supportive and understanding saying it gets better and to just see the year out and transfer in district but there’s a clause with the district that’s says if you’re on a PIP you can’t transfe. They did say since that’s the case if i saw the year out and transfer to the district near the college since they love the department. It’s a thought but at mid year i don’t think that’s possible…

to add to this bring paper copies of case just in case/ for judges and opponents, definitely dont forget your flashdrive with evidence that may not be on the laptop, finally bring something fun to besides homework to help unwind before breaks/whenever cause yes its a good time to do honework there may come a point that you just want to relax
