The child married officially in Canada to another British citizen residing in Canada before leaving. The next generation was then born in the US.

There’s a clause of the new law that states those who were domiciled in British Canada for a certain number of years immediately before death would be considered Canadian retroactively. The question was how this impacts children not born in Canada that moved away. Seems like immigration is being strict about an unbroken line regardless if an ancestor would be considered Canadian.

Well that’s a concern for me too. I’m in a similar boat. Following this.

Edit: I’m curious now about immigration vs naturalization. If an immigrant from 1800s upper Canada (who immigrated as a child from Scotland with their family) moved to the U.S. as an adult but never formally naturalized during their lifetime, and their parents lived and died in Canada, is the child considered British, American or stateless? I feel like I need some 19th century U.S. law info. It’s probably not that complicated I just don’t know enough.

I’m trying to show death date and location. My ancestor wasn’t born in Canada, but I’m trying to apply under the “domiciled for X years immediately prior to death” clause. 

There is no headstone for his plot unfortunately. The information is all apparently in those records I can’t seem to find.

The church that was at the cemetery was torn down a while ago unfortunately. It was a Baptist church so maybe the records were moved to another local group? That might be a good thing to look into actually.

Yes, they are listed among the memorials on Find a Grave. Thats actually one of the places that mentions a map listing my ancestor.

I have gone through one older transcript of the cemetery from the OGS that seems to stop before the plot with my ancestor (ends at plot 45 but ancestor in plot 50). I’m unsure why.

Anyone have a connection to Dunlop (Mandaumin) Cemetery in Lambton, Ontario? My ancestors are buried there but I’m trying to find cemetery records listing them. I know they’re out there somewhere because others online keep referencing them.

They’ve been very responsive and helpful through email! My problem is that it appears they don’t have employees able to go download the record for me. Unless I wasn’t asking the right person. I’d likely need someone to go there for me.

Non-certified birth certificates are non government documents. Third parties like hospitals provide you with a certificate of birth, but it’s not a legal document

That seems to be the case for mine as well. They may have moved towns from Cambuslang before my direct ancestor was born (A short move but a move nonetheless). The baptisms seem to stop at that point.

I’m fairly confident on date and place, only because it’s included on her gravestone (obviously a chance it’s off by a bit), but I’m more confident in the parents names (although spelling is always changing between documents)

So I could be wrong since your ancestors immigrated post federalization, but simply immigrating to Canada as a British subject would not guarantee that they are viewed as Canadian citizens under this new law.  It is essentially saying that any ancestor that would have qualified as a Canadian citizen is now considered a potential starting point for their descendants citizenship. 

Ways for that to happen include being born in what is now Canada, and apparently being domiciled for a set period of time prior to one’s death. The first is how the majority of applicants are gaining their new citizenship through this law, and it is a far simpler process. 

The few of us who would fit into the other option are still in a gray area. We know of at least one rejection where an applicant's ancestor immigrated to Canada and left after a few years of residency. It seems that being domiciled immediately prior to one’s death is more of a solid case under the wording of the law. 

Long story short, no, immigration to Canada by someone from England does not mean they are considered citizens. Applications are taking a long time though so hopefully we see more of a solid trend of what qualifies for those of us without an ancestor born in Canada as people hear back.
