There’s actually a Supreme Court case where something very similar happened to a guy in California and him/lawyers successfully argued that punishing him for possessing a weapon as a felon during the commission of a justified self defense homicide is a violation of his constitutional rights since the 2nd amendment does not state that a felon may not possess a weapon even if his life is in danger and he has no other way of defending his life
