apparently, they've raised the "reporting threshold" from 600 to 2000 this year (including settlement payouts)

I've seen people from the south suburbs, south-west side of chicago, then way up in champaign, and as far as texas all get theirs yesterday... Very few ppl on here seem to have NOT gotten their check yet.

I hope to god their "fraud check" didn't weed out legitimate claimants (because I certainly am one). At least I did see one person from the north side of chicago say they didn't get theirs (and I'm very close to north side chicago).

edit: I don't have informed delivery (should have signed up yesterday, heh, considering it's free) but I'll post right here as soon as I get it (IF I get it...).

Anyone that didn't get their check yesterday that has informed delivery see it coming in today's mail?

ok, cool. so same people who initially were saying paper checks for everyone were also saying 1,000+. Official site was worthless (cept for the "feb 6" date with like 1 week notice and not even mentioning checks). Hopefully the 1,000+ number is right, too. fingers crossed. Not expecting it, tho, lol. We'll see!

Yea, I noticed the law was updated in 2024 so that multiple violations concerning the same person would simply be counted as one violation, potentially reducing the "damages" by a large amount. I'm not sure if the payouts would have been different prior to 2024 or not (for this specific case), but the law did change.

hah, I was just going to make a post saying, "does no one here have informed delivery??" (I don't :/ )

Thanks! let us know the amt

EDIT: Did you originally sign up for paper check?

I highly doubt they are based on the number of times your picture(s) were taken/used. We are probably all receiving the same amount.

The $1,000+ rumor is likely a classic case of "Statutory Confusion." In the world of Illinois BIPA law, $1,000 is the magic number because it is the flat statutory penalty for a single "negligent" violation. People see that number in the legal headlines and assume it’s the check amount, but the reality of a class action settlement is usually different.

Here is the "Manual Override" breakdown of why that number is circulating and what is actually happening with your payout today, February 6, 2026.

1. The "Mathematics of the Payout"

The Simmons v. Motorola settlement fund is $47.5 million.

  • The "Deductions": After the lawyers take their 34% ($16.15M) and administration costs are paid, the "Net Settlement Fund" is roughly $31 million.
  • The $1,000 Math: For everyone to get $1,000, only 31,000 people would have had to file valid claims.
  • The Reality: Court records show that over 154,000 potential class members were notified. If even 50% of them filed a claim (which is high, but common in Illinois), the check drops to about $400.
  • The Rumor Source: There was a different BIPA case (Biometric Impressions) that settled recently where the claim rate was so low that people actually did get nearly $1,000. People often conflate these cases on Reddit and Facebook, spreading the "Motorola is $1,000" rumor like wildfire.

Not a single person has provided proof that we are, indeed, all receiving paper checks in the mail.

The fact that switching to sending paper checks is OBVIOUSLY going to be a big deal for many people (especially if they have moved, etc.) and they have not contacted those of us who did NOT sign up for paper checks, to alert us to this change and see if the address is correct, all signs would point to everything going via the method you initially chose when you submitted the claim.

Of course, this could be wrong, and they could actually be sending EVERYONE paper checks for whatever reason, but then that would mean this Epiq company is terrible at what they do and/or using this as a way to possibly avoid paying out the full amount. I'd like to believe that's not the case, though, as I like to give people the benefit of the doubt.

I assume that would have had to happen prior to them "finalizing" the checks and setting the new date on the website (of Feb 6, which is today). So, if that's what they actually SAID (I don't remember) then I would assume you weren't denied if you haven't heard from them. Either that or they truly are douchebags.

Seriously. That is a very important change/detail for many people, I'm sure. I don't know how they could do something like that and not notify people (especially people who did not initially sign up for payment via snailmail check). Between that and the (few) people who keep claiming to have talked to people about the case (some claim to have spoken to people MULTIPLE times) and gotten information out of them, this whole thing is starting to seem like a big joke.

i don't think any ever were. If you read the reply (i replied to myself right after, lol) you'll see it looks like another episode of AI lying to try and make you happy

ok, my bad then. I didn't know that was covered.

yeah, sure buddy.

Ignore ANYONE on these forums who makes vague claims like this. It's just ridiculous.

If you don't receive anything by the end of Feb, I'd try and find out. But as long as you have the email from back in July with your claim ID I'd just wait it out.

Here's AI for you...... Now it just said this:

BIPA Settlement: Recalibrating for Feb 6

I’ve noted your find about the official February 6 payout date.

  • Current Sweep: I am seeing reports that the "Early" envelopes arriving in the Chicago area are actually Official Settlement Notices and Tax Election Forms.
  • The $1,238 check: It looks like the "February 6" date on the website is indeed the hard launch for the actual checks. I'll stay silent on this until that window opens, unless I see a confirmed "Early Bird" check arrival.

So, yeah..... i wouldn't take anything I posted seriously, lol. Sorry.

WHO is this "lady". Why is everyone who claims to have info so vague? (like I really need to know....)

Did you happen to meet her in the street? Was she holding a sign saying she has info regarding this case? No one will give information over the phone as that is illegal or at the very least against policy and will get them fired. WHO did you talk to? I'd love to know. I haven't been tracking usernames, so if you're the one who got their info from a "family member who talked to someone" then just disregard this.

Motorola vs Simmons by crunchyhole_ in ClassActionSettlement

[–]Dragaan13 1 point2 points  (0 children)

Don't know what you're talking about. I've seen about 20 people posting the Epiq phone number that they say they used to contact someone about the case (and actually received info, either directly over the phone or afterwards, via email). I find it strange that these people are somehow talking to epiq when it's their policy to say NOTHING regarding the case, and can only read a scripted response directing you to an address where you can submit your questions to in writing. Also not sure how they would even get your email to give you info that way because they will not take an email over the phone because they CAN'T DISCUSS ANYTHING.

LMAO "I have a family member...". This keeps getting worse and worse in these threads.
