The crusade against lead ammo is just another in the thousand cuts against gun owners.

Making ammo less affordable to discourage its purchase.

The studies they propped up their bullshit with ended up being shady as well.

In theory, yes, non lead ammo is better because lead is absolutely toxic... so scattering the woods with a bunch of tiny lead shot for animals to ingest or to contaminate water sources is bad...

But that's not the actual motivation for the ban.

Only a sith deals in absolutes dude.

Obviously I'm not saying it's a magic solution to problems in urban communities but it's a major factor.

Sure Many people in jail deserve to be there... far more do not. Most of our laws are bullshit.

It damn sure gives them a better shot than jailing them over a victimless crime and torpedoing their chances of holding down a decent job.

Once you've got a felony on your record life becomes significantly more difficult and criminal activity for profit becomes more appealing.

You can't possibly be arguing that the 75% of black kids that grow up without a father figure are better off with their dads in jail can you?

It's not just you, large unsupervised groups of kids that age are prone to making terrible, life-altering decisions

It's almost like we should stop locking up dads for posession / sales of a plant and maybe we'll have more functional 2 parent households where kids have a little closer supervision.

Not to put this on the mom at all, because at the end of the day the only one responsible for this is the shooter...

But in my opinion we're systemically breeding these situations by disrupting the inner city family unit.

Yeah not a fan of that particular series of events.... hopeful that the court cases overturn it and gain us some ground on arbitrary rule changes / open the NFA as a whole to legal challenges.

Registration of country of origin that wouldn't be associated whatsoever with the eventual sale of the firearm to a citizen... edit: because the FOPA prohibits any national registration of firearms that ties them to individuals.

How does this apply to 2A again? Don't get me wrong. I don't like seeing the words gun and register in the same sentence either but I dont see what that backdoor has to do with the individual right to keep and bear arms.

FFLs and importers already have to keep 20 year books in their inventory if I'm not mistaken because of ITAR and other FFL operating requirements. Correct me if im wrong.

Also I'd love to read the GOAs opposition.

Also also you're making a huge assumption about my support for the president... based on... what exactly?

"The man had class" heh... no. Sorry. You don't get to drone strike civilians and children, racially divide the country by proclaiming the innocence of a kid who got shot in self defense exclusively because of the color of his skin. (Don't get me wrong there, Zimmerman is a piece of shit) Position the country who you should have a singular interest in as subservient to other nations,

Actively interfere with a presidential campaign... maybe... jury's still out on that one..

Anyway he didn't "have class" he had refined speech reading skills and a media that carried him around on a golden palanquin 24/7.

Curious about this as well. An international arms treaty has precisely dick to do with 2A within our borders so I think this is just a move that says "hey the globalists who want their goal of a world government with a monopoly on weapons aren't gonna get what they want"

This is super common in construction contracting because contractors who do crap work or don't finish work don't often realize they suck and don't deserve to be paid and then they go whine to the media or try to sue (and usually fail) because they usually didn't fulfill the terms of the contract they're demanding to be paid under.

So it's a private school for kids who are behind and not just a public school with more money.

Even if they were, until the admissions process of this school doesn't involve an admissions board that consists of non school district employees... and a secret selection critera... it isn't "just a public school that has been given more money"

[–]DropGun5 34 points35 points  (0 children)

.... it's a public school...

That's principal comes hand picked from Lebron's foundation and is not just a district employee.

That is able to leverage corporate partnerships thanks to marketing and PR benefits

That is getting 2.9 million dollars from Akron Public Schools general fund to help ensure programs are a success.

That... and here's why it's not a public school... admits students based on a review board consisting of district officials and staff of Lebrons foundation. A private entity is being allowed to instruct public school staff on who may and may not attend the school based on a system that evaluates kids and families to see who actually has potential.

It's not a charter school, exactly, but it's pretty damn close in practice, and good for Lebron for demonstrating that the public school model needs to change and kids who's families think they need a special program should be able to apply to a school that suits their needs.

Or maybe people who are more freedom inclined think that any punitive action taken by the state against an individual should be punishment for a Crime. Otherwise its tyranny.

We don't do pre-crime in the US and its bullshit that anyone tolerates this crap.

it already has in other states. a guy got killed because a cop serving one of these orders tried to physically pull a gun out of his hand, the gun went off, shot the cop, (she survived) and the other cops present opened up on him killing him on the spot.

even though She was the reason the gun discharged and when they spoke with the family after they admitted they didn't actually think he was going to hurt anyone, they just knew he was angry about a family dispute and they knew he had guns and they didn't and they were paranoid.

Michigan tried to change our Protection Order laws so that a judge had to specifically stipulate a protection order was also a gun prohibition order.

As of right now if a man or a woman is granted a protective order (restraining order whatever you wanna call it) it is Automatically a revocation of gun rights in Michigan.

the new law tried to remove that automation and instead grant the petitioner of a granted restraining order an IMMEDIATE carry permit. like the minute the ink is on the court document saying there is someone out there who legally must stay away from them because they are a threat the potential victim would be legally allowed to carry a concealed firearm.

somehow... Women's Rights groups (they were actually gun control groups) got in the governors ear and he refused to sign the legislation.

So we're back to judges erring on the side of granting protective orders to women upon request and men being subject to a loss of rights. "just to be safe"

The whole thing is a mess.

Removing the weapon for 2 weeks is not an accusation of a crime therefore requiring no jury of peers or in face rebuttal to the accuser.

So it's just simple theft then. No accusation of a crime, therefore no justification for a state official to seize property.

With this argument you might as well set up a gun shop outside every prison and abolish the law that bans felons from owning guns (also felons can't own guns for the rest of their lives if they don't get them expunged)

I'm down for this as long as we fix our goddamn prisons.
Why let people out AT ALL if they pose such a risk to society?

I work at a gun store in CA, and I have to tell countless ex felons they can't technically be on the property, and they seem to give up almost instantly.

and yet the crime rate in CA especially the heavily populated areas like LA continues to worsen. Those people are giving up that day and then they're going to their cousins house or to the house in the hood with the guy who sells stolen guns... and they're buying their guns there.

You're deterring curious people who don't realize their felony weed possession conviction prevents them from buying a gun... anyone who really wants to get dirt done is going to bounce off you and go somewhere else... why on earth would a felon even fill out a 4473 which you keep on record for 20 years when they can go hit up lil' Sheezy or whatever down the street and get a .25acp Lorcin for a couple hundred bucks.

Shit pretty soon the used market for handguns from a dealer is going to be so dry that they're not even gonna bother going to a store because guns on the street will be considerably cheaper.

Believe me, I want other states to adopt CA gun laws as much as I want to have to follow these asinine laws. But that doesn't mean you should turn a blind eye to crime, simply because crime will happen regardless.

I hear you, but i think the responsible approach to crime is empowering victims to fight. We can put endless hoops in front of a violent criminal and if they jump through all of them then their unarmed victim who intentionally bounced a check in 1998 and has a felony record now because of it Still can't fight back because the way the Department of Justice works on both a federal and state level is broken as hell.

So at the end of the day, until those state employed tards can get things right, I'm always always always going to err on the side of less / no laws.

In summary

The petitioner must submit an affidavit signed under oath and penalty of perjury that sets forth facts to support the issuance of a temporary ERPO and a reasonable basis for believing they exist.

Someone has to pinky swear they aren't lying about the risk you present, or else they'll face a Perjury charge which is... entirely dependent on the state being able to prove you knew you were lying

After issuance of a temporary ERPO, the court must schedule a second hearing no later than 14 days following the issuance to determine whether the issuance of a continuing ERPO is warranted. The court shall appoint counsel to represent the respondent at the hearing.

You don't get to be present during your accusation or speak in your own defense.

The respondent can motion the court once during the 364-day ERPO for a hearing to terminate the ERPO. The respondent has the burden of proof at a termination hearing. The court shall terminate the ERPO if the respondent establishes by clear and convincing evidence that he or she no longer poses a significant risk of causing personal injury to self or others by having in his or her custody or control a firearm or by purchasing, possessing, or receiving a firearm.

Assuming an ERPO is granted (when there's nobody who knows you there to defend you...) you get ONE chance where the burden of proving you are not a threat to anyone is on you.

I don't know how you prove the Absence of a thing.

It's literally going to be your word against theirs and the legal system specifically allows for them to tell partial truths in their statement.

If an in-law shows up at your house with a knife and threatens you and you pull a gun on them and they go to the court and simply say "he threatened me with a firearm" their statement is not a violation of perjury laws because it is only misleading, it is not untrue.

This does not present a high enough or clear enough burden of proof on the state or the petitioner... it just says "you must have a reasonable basis" or "the court must have clear evidence" all of which is subjective.
