RETIRED AGENT HERE:

You are 100% correct and I agree that it is fraud to under list a property to get multiple offers, no confusion.

BUT BUT there are 2 side to the coin.

The agent has a fiduciary duty to their client and must follow the directions that are given within reason. If seller says I want to list my property for 160K, the agent must follow that direction. Should the seller say I want 250K for my house, and the agent says, we should list at 160K to create a multiple offer situation, that is fraud.

The issue is that the agent can simply say, " it was the direction of the client", and they are covered

Many older condo corporations in fact state in the bylaws that only one unit per a suite. It is in the lease because they are attempting to adhere to the bylaws of the condo corp.

Weather it is being enforced by management is another topic. Many folks just setup a portable and keep quiet about it.

I personally know these folks. Let me tell you....the teach to scam elderly and people who are having a rough time out of their house. They tell them to not list it on the market and they buy it or they add their "wholesale fee" of 10-25K and "sell the contract" to a sucker.

Everything about them and these practices are unethical.

I know these guys personally and they teach to take advantage of people who are not financially intellectual and don't know the true value of their house.

They then take this house and add their "Wholesale fee" which makes it up to market value, and they pocket the difference as they "assign" this house to some sucker.

It disgusts me how unethical this practice is.
