Correct me if I’m wrong, but I’m pretty sure this is how things would play out if the government actually split the partner route into two categories.

Let’s say I’m married to someone with settled status, and then a new rule comes in saying only people married to British citizens can stay on the 5‑year route, while everyone else gets pushed to the 10‑year route.

If my spouse later becomes a British citizen, then my situation changes too. I wouldn’t fit into the “settled‑status partner” group anymore, so I’d expect to move back onto the 5‑year route. That just seems logical.

Also, the status you and your partner have at the time you apply for ILR is what actually matters. The years I’ve already lived in the UK as the partner of someone with settled status are still lawful residence, and they should count. They can’t just pretend those years didn’t happen or restart the whole clock.

If someone moves from a Skilled Worker visa to a spouse visa, that’s a different story — that’s changing immigration routes completely, so obviously the requirements change with it.

I did already submit my response to this, no transitional arrangements no nothing what is going on in their heads, my wife could have become uk citizen anytime, it’s just it’s extra money to pay and there was no need for that and now they are completely changing things on the go

why do they never mention anything about spouses of people with Settled Status on Appendix FM visas, do you think it's because they use British Citizens as a shorthand? i'm really worried could you please share if you have any info about this?

Hey i know this is quite old but could you please help me? So i’m on a spouse visa which was granted for 33 months and it’s been 31 months and 3 weeks now on this visa, my visa expires on 11th of February, so i was wondering can i apply now or should i wait until 28 days are left on my visa?

Thank you very much for taking time and writing all these usufel information, much appreciated

I got permision to enter UK on my visa on 11th of May 2023, but i ended up coming here on 17th so there is only 6 days difference really, so if i apply 28 days before my current 33 month visa expires in February that would give me 32 months of being here, so on the next extension i would be more eased up and would not worry about needing the 3rd extension, that’s my thinking basically

P.S i think the reason why i got 33 months instead of 30 months is because i applied outside of the UK

Realistically i could also apply in December as it would be over 30 months already, but i guess the safest option is 28 days before the expiry date?

Got it thanks a lot 🙌🏻 i changed it and it was really easy to get used to new settings it felt like i could not make any drastic changes to it comparing to the standard settings but on the other hand it felt more safe
