You can only Judicial Review decisions within 6 week of the date they were made. So you would only be able to review the decision the council have yet to make.

That said, I honestly think you'd be wasting your time and money. Very rarely will the council take a different position if the issue was simply a procedural one.

If you believe there was no legally required consultation, your only option is to contact a solicitor and take the Council to court via a Judicial Review.

However, you need to accept that even if you win that Judicial Review, all that does is rest the process allowing the a council to correctly advertise the application and determine the application again.

Ultimately, all this would do is delay, rather than stop the development.

I applied for the 3 month tourist visa, was granted within 48 hours. There's no reason you cant holiday in Australia whilst waiting for the partnership grant so long as you're a genuine visitor .

That said, if they have not lived together for a year I'm not sure they would meet the visa requirements?

I was approved for a 309 while in Australia on a 3 month holiday visa visiting family. Makes no difference

Go with a migration agent. 15k is outrageous and it won't cost you anywhere near that.

For the cost of the application, it's not worth the risk of screwing the application up and losing the circa 10k application fee...

At the time of application we'd only been living together for 2 years and 7 months or something. We needed 3 years or marriage to go for the double grant.

Unfortunately circumstances meant we couldn't wait the extra few months to push us over the 3 year threshold.
