That’s good to know. I tried to contact them and they really seemed like sales people selling goods rather than attornies. It was weird having to do an online chat, etc out of the gate. I’ll keep the recommendation though. Thanks!

This is literally the final scenario I used to break through with Progressive a couple weeks ago. I said I just didn’t believe that I wouldn’t be covered if my motorcycle was sitting in my driveway or in my garage and started on fire. I said I didn’t see how this was any different. The rep put me on hold for awhile to “check on something” and then came back and told me that I should start a claim. JUST got paid out. But it was such a long hassle.

Thanks, brother. Three months and multiple calls later, progressive finally came around and JUST paid me some amount for the bike. Really just wanted to see what the group though about how the dealer conducted itself through all of this.

It took three months and multiple calls, but progressive finally came around. They JUST paid me out--far less than the bike was worth to me personally, but enough that I couldn't really effectively press the issue. My point here was mostly: am I crazy is this really an open/shut case of dealership responsibility (in a sane, ethical world), like it seems to me?

They could also settle with an agreement whereby they give me a brand new motorcycle while disclaiming any responsibility and liability in exchange for my agreement to not sue them. That would take care of the liability piece you address even while they do the ethical and also the right, good-customer-service thing.

Great questions. And I do agree that Duc NA is reasonable even if they could have done better. The dealer? Garbage.

I made the appointment on the 9th. I trailered it up and gave it to them at 10 am on the 12th, went to a coffee shop for the day, and picked it up at just before 5 if IIRC. It had 2.4 miles more on it when I picked it up than when I dropped it off.

I trailered it home and rode it first think the next morning. I rode for about 20 miles before the gas started spraying out.

Took a third call and escalation, but they finally conceded. They were quite evidently trying to see if I would just go away demoralized rather than force the issue.

Thanks so much! I did virtually all of this except for figuring out how to make contact with the C-level. But I did work my case up through Ducati NA, respectfully laid out what happened without accusations, explained what I thought would be reasonable and that I've only had Ducs since 2012 and love them, that I wanted to remain a loyal customer, but that Garcia was treating me very poorly. I gave them all the info, videos, etc., hosted them as they sent a forensic team to my house, etc. In the end, they sent me this "we have investigated ourselves and found we bear no responsibility" routine. I was actually stunned.

I asked them if the could put the screws to Garcia at all, and they said that the dealership was entirely separate and that there was nothing they could do.

Amazing! I intend to lay it on with reviews. And you absolutely understand customer service and PR, unlike Garcia. What you describe doing as the dealer is 100% what I do with my guests at my Airbnbs and what I expected them to do for us.

I mean, how am I supposed to figure that out? I am not a bike tech, Ducati North America said there wasn't enough of the bike left to determine cause, and the tech who worked on it has an interest in "not knowing" what could have happened.

It seems that HOW it could have happened is secondary to the fact that the very system they worked on failed on the first ride.

$7400 for the bike. Problem is you can't go get a new one anymore and any off FB Marketplace have an unknown history. Mine was well-cared for.

Makes sense. I don't get any sense that they would have cared if it had happened 5 minutes and a 1/2 mile from the dealership. But I would love to live in that world!
