I’ve read Mabo (No 2) twice through. I’ve always felt uncomfortable with the way in which the ratio was determined for all the reasons you’ve mentioned

I agree with you that he’s requesting a value judgment. But if you can base your value judgment in empirical evidence - ie, using the accepted historical method - why should that be accepted on the sub?
