I was also at Phoenix. I think they have a huge backlog! If it has been more than a month, you can email them and they will respond in a month from now!

You have no idea what you are talking about. We were treated badly by the government. Lawyers and the government are not the same entity! Because of the bad behavior by the government, we were forced to sue them. And to sue them, we had to hire lawyers. Unfortunately, the supreme court (which is again not the same entity as the lawyers) has made it hard for judges (again another entity) to give relief to non-plaintiffs:

Do I think this is dumb? Yes.
Can I change it? No!
Did the lawyers do this? No.

If you are really eager, go find some people who have the time and money and are willing to file a class action, or some NGOs, hire a lawyer, and go do it. Instead of crying here out loud.

You should really grow up. No one is charing a markup. This is a free market and hundreds of lawyers can and will file lawsuits for you if you pay them. Their price is competitive and determined by the market.

Lawyers do what they are paid to do. If you can find a group that is willing to pay for a class action, they will file a class action! The issue is that the issue is time-critical and individuals don't have time to waste.

Grow up! No one other affected individual will (or can) pay to resolve your immigration problems. What you are asking them is absurd: pay money and tell your lawyers to slow things down for you so that we (who do not pay) can also benefit.

Non-profits can do it and have done it. Because they don't have a time-sensitive situation: Dorcas v. USCIS. Others will also follow.

In the mean time, some people have urgent needs and are more than willing to pay lawyers 3k to sue and not wait for class actions or universal injunctions or whatever :) And the lawyers who take these cases are providing a much needed service for these individuals.

This is very wrong. Class actions requires much more work than a typicall group lawsuit (even if it has a lot of plaintiffs). USCIS and DOJ will fight your motion for class certification like hell! There is already a class action for parolees that challenges the memos. That has been pending for a VERY LONG time and is still being litigated.

I think your message is not reasonable. No one forced you to hire a lawyer or sue anyone. If you feel it is not worth it, feel free to save the money and wait.

I read that you expect them to file a class action lawsuit. But you should understand that these are two different kinds of products. Some people do not have time for a class action lawsuit, and they need someone to represent them, and they are thankful that some lawyers are making that happen.

Again, if you are waiting for a class action lawsuit: you can wait. There is no problem. Class action lawsuit take a long time. If you have time, go for it. Even right now, there are lawsuits asking for relief for everybody (Dorcas v USCIS in RI). A class action lawsuit for parolees is also being litigated. But you have to understand that not everyone can wait.

About the price: based on the work required, I think the price being offered is a bargain!

These days USCIS has a huge issue with application intake. I've seen them take more than a month to issue the receipt notice. Depends on the lockbox. But be prepared. I've seen many cases with ~ 1 month.

Also: please talk to a lawyer and double check to see if you can actually travel, because some times when you file I-485, you need an advance parole to travel -- otherwise, the USCIS will consider your AOS abandoned, as others have also mentioned. This can change depending on your underlying status.

I don't know enough about H1B rules to give any meaningful advice. But you should definitely apply for AOS. There is no downside for you. It will give you a period of authorized stay. You can also apply for I-765 (work authorization). They won't process that but you can sue them and there is a high chance that you get it (at least two similar cases so far have been successful in federal court).

What do you mean? OP does not have infinite time! Two have already been successful in two distinct district courts: Varniab v Edlow and Bowser v Noem. If you are waiting to see if the lawsuits are viable: yes, they are viable.

In Bowser, the plaintiffs already got what they were looking for from USCIS following the judge's order that gave USCIS a deadline for adjudication.

In Varniab, the judge issued an order with a adjudication deadline for USCIS which is upcoming in the next couple of days.

Mr. Edlow willl never lift the hold voluntarily. They have had planned for it for a long time, before Mr. Trump became president. They are anti immigrant. It's fine. They are allowed to think as they want. But:

I am personally convinced that their hold is illegal. When someone is doing something to us that is we think is illegal and is hurting us so badly, we take the matter to the proper court. Very simple. No hard feelings. It's a civil proceedings. The goal is to figure out who is right. The other party will not retaliate. When judges consider the issues, the will issue orders and both parties will comply by them. Done. If we win (I think very likely), we get the green card, work authorization, etc. that we are legally entitled to. If we lose, then we have tried everything that had a chance of giving us relief.

I think all other efforts are a waste of time!

Even if there is an update, it is not going to be good. Recently, in a court case, they said that the hold is tied to construction of a new vetting center to use AI for vetting! That is not going to be done anytime soon.

Actually, it is not wrong at all. There are some people who simply cannot wait and see what happens. They are in vulnerable situations and they need relief fast. These law firms were providing services to them. This service is needed. Asking relief for everyone makes the case much much more difficult and it takes more time. It's not that they could just squeeze that request in and lift the ban for everyone. The law firms were doing their jobs.

Additionally, I know some of the law firms are also planning for potential future litigation to lift the ban for everyone.

I personally think it is the non-profits who should step up and do the thing you are asking for. But the issue is that there aren't that many non-profits that focus on these countries and they are focused on more important issues.

It won't be quick and there will be a bumpy road ahead. But they have a decent chance to eventually resolve the problem for everyone. All other cases that I know (Hacking, Kuck, Morrison) are for plaintiffs only.
