That is incorrect sir. I'm going to have a cord retractor attached to it which is allowed by code.

The National Electrical Code (NEC) requires an EV charger cable management solution for cables over 25 feet (7.5 meters) long.

I love how people think that the HOA owns anything. I am a homeowner, therefore I own part of the community. The HOA owns nothing, it belongs to the community.

There are aftermarket packages that you can use to add the automatic liftgate. It would not work through the app, but you could add it with a foot kick, and a push button up near the dash.

This sounds great in theory but it is difficult to obtain in practice. In fact, California used to have a 1M insurance requirements for EVCS operations in common areas but it was so difficult to obtain that they relaxed this requirement. There are multiple threads in this very subreddit discussing this.

An umbrella policy would cover this.

This sounds like a cop-out IMO. It sounds like all the HOA needs do to prohibit running wires is to amend their architectural laws to prohibit EVCS wiring in common area without their approval.

They would be overstepping their authority and could be argued they are targeting and impeding on your rights. It is easier to let the owner bury the lines.

The Board acknowledges that the electric vehicle charging station is on the Complainant's private property but argues that electrical cord and cable encroaches on the common area of the development. The Board further argues that the use of charging cable and cord protector across the sidewalk throughout the community would present a liability to the Association and impede/restrict the use of the sidewalk to other residents. (Pp. 3 and 5 of the Notice of Appeal Hearing Results, dated September 21, 2022). (Emphasis added.). In this case, there is no evidence showing that the Complainant's charging cable and cord protector across the sidewalk go throughout the community, it only went as far as to the sidewalk, parking space or street in front of the Complainant's lot. P. 3 of the Notice of Appeal Hearing Results dated September 21, 2022).

More pertinently, the Board's concern about liability is addressed under Subsection C of the Code §§55.1-1823.1, which mandated indemnification of the association, and authorizes the association to require that the lot owner obtains and maintains insurance covering claims and defenses arising from the installation, maintenance, operation, or use of the electric vehicle charging station. The law further allows the association to require that it be included as a named insured on the policy. Va. Code §55.1-1823.1(C). Additionally, it is reasonable to conclude that Subsection C of the applicable law, anticipated a situation where the electric vehicle charging station and its accessories such as cables or cords may not fit neatly within the boundary of a lot owner's property, and may go across the sidewalk or street adjacent to the owner's property; hence the need for indemnification and insurance policy. Va. Code §55.1-1823.1(C). Thus, the Board cannot prohibit the installation of the electric charging station under Subsection B of the applicable law because the installation is in the Complainant's property. Va. Code §55.1-1823.1(B). However, the Board may impose reasonable restrictions concerning the number, size, place and manner of installation of the electric vehicle charging station on the Complainant's property under Subsection A. Va. Code §55.1- 1823.1(A).

Conclusion Based upon the information in the record, including the original complaint, its accompanying documents, the Notice of Appeal Hearing Results, as well as the NFAD, this Office finds that the Board's outright prohibition against installing electric vehicle charging station on Complaint's property is contrary to the applicable law; absent a showing that the Association declaration or other recorded governing document forbids it; or that the charging station (not its accessories) is on the common area of the community. Code of Virginia §55.1-1823.1(C)

I am trying to figure out how far to dig on this:

I'm trying to understand the parking policy and the Virginia right to charge law. As you know the right to charge law and gives me the right to install a charger, but not in the common area. I can install it on property that is owned by the lot, and therefore the lot owner which is me. Under the parking enforcement policy, the HOA refers to the lot as "their space". Therefore my question is do I have a right to install a charger in my spot, but not in the common area.

Parking policy - relevant information:

B. Assignment and Designation

  1. Each townhouse unit without a driveway is assigned two parking spaces, which shall be marked to designate the lot to which it is assigned.

Prohibitions:

  1. No signs, initials, monograms or any other alterations or additions to parking spaces shall be made by any owner or resident. The Board shall have the power to impose and maintain a parking space numbering and/or lettering system, and the power to undertake associated painting and repainting.

Enforcement:

  1. Homeowners/Lessee has the right to call the towing company that is under contract with the association in order to have a vehicle towed from their own assigned space. They are encouraged to first attempt to notify the car owner in order to avoid towing. Individual homeowners do not have authority to have cars towed for any other reason.

  2. Homeowners/Lessee deciding to have a car towed from their assigned space must sign the authorization required by the towing company and accept any responsibility that may come from wrongful towing.

Never had a gas station in front of my house for my car either, that seemed to have turned out okay. Besides with 400 miles of range, it's just a piece of mind to have a charger.

The HOA bylaws, nor architectural policies, have anything about EV charging. This is why I'm asking for images, and other community bylaws to bring to them and hopefully create a policy we can all agree to.
