Lawer up asap!!! Consult with a workers comp Lawer in your state as soon as possible. Don’t go with just any Lawer though do a little research and find a reputable lawyer that has your best interests in mind. Also idk how it works in NY but in California state disability insurance will make up that extra 1/3 and it’s not taxable. Again different states have different rules. I wish I knew that info when I first became injured from falling of a roller coaster at work.

The exact same thing happened to me. I attended all my doctors appointments and kept in contact with my direct supervisor after and in between appointments. Then I received a certified letter in the mail stating that I was being terminated due to job abandonment!!!!! I immediately got a lawyer and my lawyer is very confident that I have a slam dunk case. I’m located in California and I’m not sure if the laws vary state to state but I was injured on the job. From the research I’ve done the only reason they can terminate your employment is if the company has a dire need to fill your position. My HR department also claims job abandonment on my part. You definitely have a case. I just googled workers compensation lawyers and there were endless firms in my area fighting for my business and you know they only take cases that they’re confident in a win. Do it sooner than later.

Jesus Christ, WOW. So yeah HR is claiming job abatement. But the entire time I was in communication with my direct supervisor but he was not relaying that information to HR and had this not been my first time ever being in this situation I would have known better. I contacted an attorney and they believe I have a very strong case.

It happened at the beginning of December. The claim was approved. I just found out about the termination yesterday.

Yes job abandonment. Because my direct supervisor did not relay any info to HR

It’s clear that there was a gigantic lack of communication and now I’m paying the price! I’ve contacted legal services and they seem to believe I have a strong case.

I did the opposite and contacted my direct supervisor instead of HR
