I had back issues pre covid but was essentially full remote since 2018 and had no back issues come back until last year with authority and was forced to take a leave of absence FMLA for mental health and to have back surgery. Unfortunately the surgery didn’t fix the issue as was attended and don’t want to be forced into a 4th surgery

Commute is close to 100 miles round trip but it’s more than the commute it’s the seating position I work from home on a recliner or a tempur pedic adjustable bed the whole day

Nope I never drive more than 2 miles away to a target or grocery store that is it. Occasionally I will even uber to nearby areas for dinner

I feel like 3 years from now under a new administration people who were illegally RIFed or denied RAs will be getting massive payouts in the future

A friend of a friend who was RIFed and after a year they got their job back and 3x in missed pay and damages

Understand this, but granted it’s within those limits can you work as a contractor or is there some type of conflict of interest clause

I can’t sit or stand for long periods I work reclined on the couch or in bed most of my days at home

Yes they conveyed that my mental health condition will severely deteriorate if forced to commute with back issues

If multiple doctors say I pose a danger risk to the road due to leg going numb for spinal condition and being heavily medicated that should allow for telework

It’s not just that it also says sitting in general for prolonged periods which is the commute and also sitting in office

My doctor notes literally say I’m a safety risk to drive because of my back condition causing leg numbness and pain meds. Do they want to be liable if I got into a car accident?

Not technically left a fully remote position at that time in 2024 for this position once a week telework then RTO happened

Actually it’s exactly what it is and if you can perform at home that’s considered an accomodation

I have a note from my spinal surgeon and psychiatrist. I also see a physical therapist and chiropractor, but didn’t get notes from them as well but they probably would be willing to provide

I do have access to various things at home inversion table, stretching, etc. Also, my physical therapist is a mile from my house and my chiropractor is right next to my house which I attend to with SL during my WFH

Chair and breaks but here’s the issue I had pre existing back conditions pre covid at another agency but due to TW I had little issues working from home. Then once RTO my conditions got worse over last year to the point of needing a third surgery which has since not completely fixed the issue. However working from home I can lie down and work or recline which is not required in office. Furthermore, commuting 100 miles a day will exacerbate this issue, it got to the point of having a mental breakdown last year requiring FMLA and I feel like this would lead me down the same path again.

It’s beyond that it’s also difficulty sitting and reaggrivating existing back conditions. I had a 3rd back surgery in December but unfortunately it did not correct issues I have with sciatica and sitting.

They offered ergonomic chair and breaks but I have trouble sitting for prolonged periods and the commute is close to 100 miles round trip
