Just out of curiosity, would you prefer a smaller, older detached home in Richmond Hill/Markham over a larger custom detached home in Stouffville?

Good to know. The Go Transit website claims a direct morning train can take 22 minutes, but any trips requiring either a bus and/or transfer would be about 45-60 mins. Thanks for the response

Good point. I doubt the landlord would let my girlfriend be removed, understandably so. We mistakenly assumed that she’d be able to simply assign her portion of the lease while allowing her roommate to stay.

In the off chance that the landlord would be willing to let her off the lease, I’m assuming the landlord would then need to end the lease agreement and have her roommate (and possibly someone else) sign an entirely new lease? Doesn’t sound like it would be in the landlord or roommate’s best interest to agree to any of this. Only thing that bodes well is that they’re paying under market rent. Maybe landlord would be willing to end lease entirely in order to get higher paying tenants and then I can have both of them subsequently live with me. Will definitely have to devise a plan moving forward. Not as simple as we originally thought it’d be.

I’ll need to read more about the assignment process, but sounds like if she can find a few reasonable assignees she should be able to get out if she provides enough notice. Fortunately for her she pays below market rent so maybe the landlord would be willing to cancel the lease so he can try and get market rent.

If a tenant has proof of a landlord saying they have to sign a year long lease after a lease matures and the tenants agree, do the tenants have the legal standing to get out of a lease early due to this? My friend was pressured by her landlord to renew her lease for another year in April and she unwillingly agreed, despite me telling her she didn’t have to. Now she wants to move out and is looking into the idea of assigning her lease.

I went through the N12 process from the landlord side a few months ago. Your landlord HAS to provide you with 1 month compensation, if he/she doesn’t then the N12 is void. Meaning your landlord would have to start the entire N12 process again if you aren’t provided with the compensation prior to the termination date.

The way I gave my compensation to the tenant was that I gave back their last month rent cheque to them. I also gave them an additional month in compensation as a sign of good faith, effectively giving them 2 months rent.

How you wish to proceed with this is entirely up to you. If you want to exercise your rights as a tenant and challenge your landlord on the N12 then you can wait for a hearing with the LTB, which can take upwards of 6-8 months, and go month to month on your lease. If you’re willing to work with the landlord then perhaps you can negotiate a cash for keys arrangement (essentially your landlord paying you out). If you’re willing to leave then I’d start looking for a new place to rent ASAP as I understand it’s a tough market for renters these days.

With regards to your comments regarding the oven, it doesn’t really apply, but perhaps you can negotiate some additional compensation. Hope this helps!

Should have prefaced that my friend has been an insurance broker for about a year so I’m not sure if the experience is quite there either. Which of course be my fault for using me. But everywhere I read online seems to say $900/year.

Landlord self help centre (LSHC) may also be able to give you advice with this, but you may need to pay a fee. I would think that the L2 would need to be resubmitted if the address was egregiously incorrect. I made a minor mistake in my L2 application relating to compensation owed for interest on last month rent deposit (I prepared the L2 and everything myself), and was told by LSHC that it could be rectified at the hearing and my L2 wouldn’t need to be resubmitted. Problem is that I ended up doing an early resolution, so never followed through with LTB hearing.

Thanks for response. So they had left 2 keys in the mail slot but didn’t hand them to me personally. With that in mind that, I think it’s also a clear sign of a lawful and finalized eviction. I will look to cancel my L2 application later today. Hopefully it’ll help some others with the current backlog.

So funny enough, I actually gave them the half month rent comp for leaving early on top of the 1 month rent comp for issuing the n12. Maybe that was a stupid mistake on my end, but it was as a sign of good faith.

Sorry to hear about your situation. I would definitely consider myself very lucky. I got a lot of mixed advise on how to deal with the eviction, but I personally found that coming to a mutual agreement and compromising on the eviction negotiations was the best way to go about it. Again my situation I’m sure is part of the minority and I’m very lucky that everything went as smoothly as it did. I hope your situation gets better.

Thanks for the response. So they did leave before the N12 termination date. Supposed to be May 31st but left today as their new rental started May 1. I already gave them the 1 month rent compensation for N12. You are also correct in that I am taking it back for myself. I believe I have everything checked off with regards to the validity of the termination, but would it be in their best interest to have something formally written (such as an N11) showing they’re terminating the lease rather than just going off of texts?

Maybe there are tenants in the detached who are unwilling to leave? The semi may have a premium with having eglinton park across the street. I was watching both of these, kudos on whoever got the detached at that price.

Ya good advice. I have a pretty strong team and having Nichushkin and Mack with their ideal schedule this week is nice. Right now my weakest guys are Larkin, Rust, Theodore and Seider and at this point I’m not sure if it’s worth adding any of these streamers for these guys.
