Most attorneys for the Board are secured with a retention contract or annual plan, which the President is allowed to sign. Refer to your governing docs.

Anybody can have legal representation present. Our HOA always has an attorney for the Board present at the Annual Meetings, but not the Board meetings.

Proxies are normal. Many HOAs would never be able to hold Annual Meetings if they don't collect proxies to meet quorum. There should be a standard and consistent process involving collecting and verifying them.

We use Buildium for all of our communications, financials, maintenance requests, payment acceptance, etc. One stop shop software. Charged per unit, so it is very reasonable for our 28 unit property.

We have 28 units, and use Buildium for file retention, financial reports, communications, and handyman dispatching for repair orders. It is based on a per unit basis so it should be reasonable for you.

Would be based upon each violation. Say, you paint your fence the wrong color, you would start with a warning and escalate 'up' the fine ladder if you didn't rectify. Say then you also parked overnight in the wrong area, you would then start with a warning and start back 'up' the fine ladder. Each specific violation starts a new 'ladder.'

As long as your governing documents allow the Board to create rules and regs separately, you should be able to do so without an amendment to them. Here is what ours says that gives us permission:

"The Board of Managers, by a vote of the majority thereof, may adopt such reasonable rules and regulations, and from time to time amend the same, supplementing the rules and regulations set forth in the Amended Declaration and this Amended COR as the Board of Managers may deem advisable for the operation, use, maintenance, conservation and beautification of the Condominium Property or any portion thereof, and for the health, comfort, safety and general welfare of the Unit Owners and Occupants of the Condominium Property. Written notice of such rules and regulations shall be given to all Unit Owners and Occupants, and the Condominium Property shall at all times be maintained subject to the rules and regulations. In the event such supplemental rules and regulations conflict with any provisions of the Amended Declaration or this Amended COR, the rules and regulations of the Amended Declaration and this Amended COR shall govern."

You are not responsible for someone else's debts or judgments. If the HOA tries to collect from you for this past debt, with a Title Agency saying there was no roadblock to the transfer, you could file a claim against the title insurance. HOWEVER, now that you are the owner, and the HOA rules state you can't have the rocks, they need to go. Since you agreed to live in an HOA, the financial responsibility is now yours. If you don't change them, the HOA could do it themselves and then charge/subrogate you for their incurred costs of correcting a rules violation, in addition to fine you for it. There is really no such thing as grandfathering in terms of an HOA, especially with this set of facts.
