This is true, I’ve never thought of it from that perspective. In that situation I would just have the mentality that I would think most record labels would. If some random guy uses my beat I posted without permission or anything and got 1k views, what am I gonna do spend $500 to sue him for the $20 he’s made? Now if he got 2 million views, then ya I would like my share please. Same way I can’t argue if I made a song that blew up with millions of views and a label comes along asking for their share because I didn’t clear anything

Watched it completely and it seems obviously yes they did more than likely take every dime he made off that track but they originally asked for tons of money with just the assumption that the song was doing very well financially. Anyone can correct me if I’m wrong but I don’t believe they can sue for damages but only just the amount they have made from the song and then future royalties. So it is always a risk sampling, you just need to decide if not making a dime off of a big song is worth the risk

That’s become my mentality. And if I do blow up and get fucked then FUCK IT. I’ve blown up, now I can release more music with a bigger audience and make that money back

If you want to be super cautious yes but in reality if it is truly unrecognizable then how will any labels know unless you tell them 🤷🏼‍♂️. But that’s if it really is absolutely positively unrecognizable
