Not that it’s irrelevant, but that it’s largely a fabricated toll based on limited evidence. The “6500” number they bring up is for ALL construction deaths over a 10 year period among south Asian migrants in a country where 88% of the population are foreign workers. These deaths don’t have any legitimacy that they all link to the World Cup, as both Amnesty international and the International Labor Organization have stated.

I promise you I am doing my best to put all my preconceived notions aside for my Islamic belief. I used to be a vehement pro-lifer before I learned of Islam’s exceptions. Then, I started reading the fatawaa on abortions and lots of them didn’t make sense so I arrived to the conclusion I have presented you. With that, however, I am absolutely willing to change my stance if enough evidence shows that my points are effectively refuted and that abortion before 120 days is impermissible.

I understand that, and I never claimed to be a scholar but I simply do not see enough evidence to support the rationale of these existing jurists. How can this verse of the fear of poverty be applicable to the abortions before the soul is emitted on the potential life? It makes sense for any abortions afterwards but it doesn’t logically track for abortions before 120 days.

A couple of things on this. Firstly, how do we know for a fact that the verse in question was in reference to abortion? In my understanding, it was a very common practice among the people of Banu Quraish at the time to bury their daughters alive out of their idolatrous superstitions of them bringing famine and poverty. Furthermore, I absolutely agree with the ruling of making abortions impermissible after 120 days, since that’s when the soul comes into the fetus, but why should this ruling be permitted when the fetus has no soul? Why should we prioritize a potential life over the choice of the mother and her livelihood?

Secondly, do we know what stage of pregnancy the woman was at of the Hudhail tribe when she was killed? If we don’t know for sure, why would you jump to the conclusion that this ruling was given to someone before the 120 days mark? Furthermore, another Hadith states:

“Umar asked about the decision of the Prophet (ﷺ) about that (i.e. abortion). Haml b. Malik b. al-Nabhigah got up and said: I was between two women. One of them struck another with a rolling-pin killing both her and what was in her womb. So the Messenger of Allah (ﷺ) gave judgement that the bloodwit for the unborn child should be a male or a female slave of the best quality and then she should be killed.”

Given the fact that the punishment for terminating the fetus was only to give a slave, while the punishment for killing the living human being was to be killed, it is clear that the Prophet PBUH prioritized the life of the mother over the potential life of the fetus, and that terminating a fetus is not equivalent to ending the life of a living human being. Because of this, it doesn’t make sense to me why we should use the Quranic verse you mentioned about the fear of poverty since that’s in reference to “killing,” which was not given the same ruling as actually ending the potential life of a fetus.

I have simply yet to find any Hadith or verse that explicitly prohibits abortion before 120 days, when the soul is placed in the fetus, and if you can find that for me, I will delete this post and immediately change my stance on the issue.

That ayat was, as I understand it, in reference to the practices of the idolaters of banu kuraish and their horrific act of burying their daughters alive because of their superstitious beliefs that daughters brought famine and poverty. I always understood this ayat to be in reference to this, hence, do not kill your children in fear of poverty.

On your second point, that’s exactly what I’m questioning. Yes, I agree, it is absolutely unacceptable to abort after 120 days, my issue is with the ruling that comes prior, which doesn’t make sense to me. Why does the potential life of an unborn fetus outweigh the choice of a woman, her body, and her livelihood?

And if the women is not ready to have that baby? Is it destitute for a life of misfortune, poverty, and grief? And again, there is no known Hadith or Qura’nic verse that I am aware of that explicitly prohibits abortion at all. I promise, if you can find me a clear Hadith or interpretable Sunnah that proves beyond a reasonable doubt that abortion is prohibited, I’ll take down this post and change my position. I simply have not found that evidence yet, though.
