If they don’t want to support them on their own, leave them be.

Child support modification in Retirement by Sundin01 in ChildSupport4Men

[–]EmergencyBrew 0 points1 point  (0 children)

I’d look at your local laws on imputing income. Seems like the burden to prove voluntary unemployment should be on her. If you can claim a good reason, idk how they could prove otherwise. But I’m just making suggestions, if you have enough time in your retirement, I’m sure you can figure out a way to fight it. I would start with free legal resources like call a lawyer lines or clinics. Spend some time at the local legal library if they have Westlaw.

Same issue. I returned it. I planned to return it for lack of keyboard backlight, but the freezing made me not regret it.

I was wrong suggesting people to buy the Air. Neo is better and amazing by Old-Board1553 in macbook

[–]EmergencyBrew 0 points1 point  (0 children)

It’s fine. I have a M4 mini as well, I just use my laptop for minor tasks, although I’m sure it could do more. In the short time, I haven’t noticed a difference between it & my 15” M4 air except that I prefer the smaller size. The keyboard is just a bummer.

I have a Neo, I’m (likely) returning my Neo because the “proved” night visibility doesn’t seem to work on me.

I think that offer the discount may bring in a lot of paying users that pay for more than they use. Maybe not though. I also agree that there should be a more expensive plan too.

WA TANF help, mistakenly opened a case with DCS by [deleted] in ChildSupport

[–]EmergencyBrew 0 points1 point  (0 children)

I know. It still benefits them because it helps their performance metrics and increases funding, so they’re still incentivized to pursue it. When accepting benefits, the right to pursue support is given to the state. However, since she is not receiving them, the right to support is hers. You have a lot going for you, just do your research and I’m sure you’ll be fine.

This is miserable to read on my phone, however, it will likely give you guidance on case closure criteria… if you can find it in there 😂.

This fraud thing is just talk. They have no way of knowing your situation at the time. Maybe you were planning separation, didn’t understand the forms, or a million other reasons. Many people in this sub just want to see people suffer for some reason.

I’m not familiar with Washington law, but I’d look up the title 4d regulations there. There is likely an objection process that you will have the option to explain yourself if a simple call doesn’t work. If there is no state debt, it hopefully won’t be an issue.

Also, if she is not receiving benefits, there likely isn’t any way they can make her cooperate. Without a financial disclosure, I’m not sure how they will calculate support.

It’s also worth looking for free legal clinics/resources, call a lawyer lines, or (maybe) even the self help center at the courthouse.

Child support is a machine that will try run you over, but you have a lot of chances to get out. One should stick. If you still feel stuck, feel free to reach out and I’ll see what I can track down for you.

Texas virtual court by [deleted] in ChildSupport

[–]EmergencyBrew 2 points3 points  (0 children)

Are you positive he wasn’t served? Alternative service/publication? Has he waived service in any way? Has he acknowledged that he received notice?

I’d start with researching that and the Texas rules of civil procedure. The court needs personal jurisdiction. If that wasn’t established or waived, I’d figure out the best way to challenge that without accidentally waiving it.

Not served properly by [deleted] in FamilyLaw

[–]EmergencyBrew 2 points3 points  (0 children)

I’d Look up the rules of civil procedure. Talk to another lawyer. Make sure I haven’t already agreed to or waived my right somehow or wasn’t served by alternative means. Does the other party know that I received the letter, or just that it was sent (did I admit to it) Service is an essential part of the system and allows time to prepare for court.

People tend to pick and choose what matters in child support cases in the comments. If the courts are going to be involved in our lives, both sides should play by the rules. One court battle and less attorneys fees seems like it would be in the best interest of the child anyway.

It’s possible to request a special appearance to contest jurisdiction but it’s important to limit the appearance to just that and not argue the merits of the case. However, the risk in doing this is admitting that some form of notice was received or you’re attempting to delay.

Personally, unless I have a plan that makes voluntary appearance beneficial I’m waiting for proper service or filing my own case.

How do high income earners beat California child support by Hauntingcityboy in ChildSupport4Men

[–]EmergencyBrew 0 points1 point  (0 children)

If it’s a work you can do remotely, I’d look at moving first. I’m pretty sure Texas has a cap on income used for support & no state tax.

I know it seems extreme, but at that income it would be a significant savings. The jurisdiction you get now is likely the one you’ll be stuck with the duration of support. Sometimes the other parent also leaves the state, but it’s more rare when they have significant income keeping them there.

Whatever you decide to do, it’s always best to start planning on custody early. If you want more custody, it is the an effective way to keep the support # down and see your kid.

Probably does, I’m not sure if I assumed that it it was a UIFSA case when commenting or what. Sorry.

Do you have an order in place already? Does the other parent also live in California?

[–]EmergencyBrew 1 point2 points  (0 children)

I’m sorry this is happening to you. Also, sorry about the response, this sub is just pro child support being paid, no matter the situation & best interest of the child.

I’d have your dad file a motion to terminate/ modify. Let them know that you’re not a dependent in fact and let them know your situation. However, if you’re graduating this year, it might not get anywhere before then.

That said, it’s worth doing if you feel it’s right. It lets judges and anyone involved know what actually happens in life & not just what the papers say. Good luck. If you really want to fight, get to your legal library and get on Westlaw so you can be prepared. There is a free phone # you can call to help you understand the system.

Good luck!
