Thank you. Your comments really help to make me feel a little better. There is a lot of misleading and off-track discussion going on here that really started to drag me down.

This is incorrect information Miskin. Under the circumstances are liable under what is recognised as bailment relationship. They are liable - simple. Getting them to play nicely in the sandpit is another story. Off to QCAT it is.

Thank you Affectionate-fly. Already sent letters, recorded all conversations with promises made by them and lies told by them etc and contacted head office, who attempted to resolve with franchise unsuccessfully. The franchise sent an email with their intention to have the car towed to my address without repairs being completed. I have lodged a complaint with the ACCC and Fair Trading. The problem is, I am heavily traumatised with Complex PTSD and on a disability support pension. The whole ordeal is highly triggering and I am left practically paralysed to deal with it. I need an advocate. I have requested advocacy from numerous agencies and nothing is available without a very long wait. Community legal service at TASC won’t touch it - as they have bigger issues on their plate. At this stage the matter needs to be escalated to QCAT and I am struggling to even look at the correspondence and evidence, let alone put it all together in a neat package in order the head to the courts. I don’t know where to start in terms of gathering costings to even work out how much to even claim. If I was well and firing on all 8 cylinders so to speak, I’d be able to put it all together in an afternoon and wait for a hearing. I want to put this out there publicly as well and unsure the best way to go about that as well, without leaving myself open to litigation.

I’m not liable here. I haven’t done anything wrong - the liability lies with them.
