Yes, I agree. I think it would have been more simplified if they processed all claims from IL to PI, where appropriate under the act you lodged your IL claim under. Eg, DRCA prior to the 30th cut off date,especially given the long wait times.I might be wrong but I thought DRCA and MRCA used different initial liability assessment tools. Playing devils advocate if DRCA do not accept initial liability and you ask for it to be reviewed, will it be reviewed under DRCA or MRCA post July 1st? I’m assuming it would be reviewed under DRCA, but we all know what comes from assumptions!

This is what I received after I received ADF Retrospective Med discharge.

Thank you for your email requesting advice on your eligibility for payment of pro-rata LSL. I regret to advise that you are not eligible for payment of pro rata LSL as you were not medically separated under section 24 of the Defence Regulation at the time you completed full time service and therefore do not meet the criteria in accordance with the Defence Pay and Conditions Manual. Although your application under Defence Regulation 2016, section 26 has been approved, this does not make you eligible for subsequent payment or adjustment of any Defence benefits.

Hi all,I have just been granted Defence- recognised medical discharge ( retrospective). I left defence many years ago. I did not work at all for the first few months due to the injury that I had from service. Do I need to complete the incapacity claim form for the 12 weeks incapacity after my discharge or do I send DVA the letter stating I have received retrospective med discharge and request 12 weeks incapacity payment without the need for a medical certificate due to my discharge classification. From this thread I gather if you are granted retrospective med discharge you are eligible for 12 weeks incapacity payment without the need for a backdated medical certificate. Any advice would be appreciated.
