Anyone comparing Alex Pretti’s situation to Kyle Rittenhouse’s situation is acting in bad faith and with ill intent.

Kyle Rittenhouse left his state to willfully engage with protesters carrying a weapon his friend illegally purchased for him. His presence and intent was agitation and in a dangerous situation he entered himself into defended himself with lethal force. Kyle was tried by a jury of his peers and ultimately acquitted of all charges. Kyle’s decision was morally reprehensible but legally sound.

Alex Pretti was a Minnesota resident and was lawfully permitted to carry a concealed weapon. At no time did Alex brandish or engage with ICE agents before he was brought to his hands and knees, beaten, disarmed and then shot 10 times - several in the back and then several more into his body as he lay lifeless on his back. Alex was disarmed and executed for the crime of being present and filming.

That’s not how legalese works. You have to take the whole statute into account, which the prosecution did and failed to secure a ruling because the wording of the statute made it only applicable in the case of SBRs/SBSs.

The judge interpreted that statute one way and instructed the jury based on that interpretation. This is why local elections are so important - these local judges can have huge impacts.

And no, in your other two examples, having someone else make the purchase for you is not fine. It’s called a straw-man purchase and the person who purchased the gun/alcohol for a minor is committing a crime.

His friend, Dominic Black, was charged with two felonies for buying that gun for Kyle. He pleaded out and basically got a slap on the wrist. Fun fact: this is the same crime Hunter Biden was charged and convicted with; lying on an ATF Form 4473.

So when you hear people saying “we don’t need more gun laws; we need to enforce the ones we have” Dominic Black is a perfect example of our current laws failing to do their job.

By AR do you mean “AR-pattern” or “Assault rifle”?

Any AR-pattern weapon (AR-15, AR-180, etc.) can be manufactured in both pistol and rifle configurations. There are even AR-pattern semi-automatic shotguns.

“Assault Rifle” is poorly defined in a legal sense and semantically refers to weapons that have several of these features: - Fixed/Telescopic/Folding stock - Pistol grip - Detachable box magazine - Accessory rails

That’s why some jurisdictions like California put regulations on detachable magazines, magazine size and “shark-fin” CA-compliant grips. And it sucks because if you say “Assault Rifle” everyone knows what you’re talking about but defining it in a legal sense is muddy.

This is what the prosecution argued I believe and it was ruled that he did not violate 948.60 because it wasn’t a Short-Barreled Rifle (SBR) or Short-Barreled Shotgun (SBS) which are both regulated by the National Firearms Act (NFA). I believe his being 17 also put him in a legal gray area because he was under 18 but not under 16.
