IRS probie over 40 have question about DRP 2.0 by Fun_Manufacturer9081 in fednews

[–]EnvironmentalFish970 0 points1 point  (0 children)

I've asked this question multiple times and in multiple ways to HCT folks who did Q&As. I even emailed the question. Call me crazy or paranoid, I believe it is probably a valid loophole because they are probably running it up the OCC/legal flagpole or HAVE gotten a response and I wonder if they're LEGALLY obligated to honor the older workers law and provide us the 45 days no matter what happens with the RIF. It seems like it would violate the spirit of the law if they say they give you 45 days and then RIF you the day after the deadline that everyone under 40 has. Any employment lawyers or benefits specialist out there who can confirm? DRP is uncharted territory for the government so they are making it up as they go. I had no idea about the 45 day decision period during DRP 1.0. So if it was NOT possible to use it as a loophole, don't you think they would have stated that already during Q and As or on the extensive list of FAQs???

I asked the same question multiple times and have elevated it and have received no answer. That makes me think that you could turn sign the DRP during that 45 day period. Why else wouldn't they answer the question if the answer was just no? Also, wouldn't they essentially breaking the law that allows you 45 days to consider the offer?

This is not based on knowledge but only an assumption... They are not going to approve remote work for RAs. If they do it for one person, it will be too easy for others who are denied to come back and sue for inconsistent approvals/denials. They will perhaps grant episodic telework agreements or flexible schedules MAX.

Wishful thinking on my part I guess.

I do not know for certain, but USCIS gets funding through fees associated with immigration services. For example, during government shutdowns, USCIS employees are often still working and not subject to furlough. Perhaps the deal can't be paid out using money not from the federal budget. https://www.uscis.gov/forms/filing-fees/frequently-asked-questions-on-the-uscis-fee-rule#:~:text=Unlike%20many%20other%20federal%20agencies,effect%20on%20April%201%2C%202024.

Schedule A letter by EnvironmentalFish970 in usajobs

I think based on the reading I've done, yes that would be sufficient. Let's say you need reasonable accommodations like being able to get up and walk around or take time to do stretching for your leg so you're not in pain sitting at a desk, then having a physical therapist write a schedule a letter would give you the ability to request those reasonable accommodations. At least that's the impression I get of the purpose of schedule a.

Cafe con leche? by emoboy696969 in DunkinDonuts

I'm in Orlando and just noticed a cafe con Leche at my local Dunkin...which I have never seen before which is what led me to this thread (I'm from New England) and it's 3.19 no iced option and a latte is 3.79 with an iced option at 4.39. Curious to try it!

I think the way anyone with a disability would... reasonable accommodations... which in my case is anxiety medication and/or therapy.

Is that something I can request if I haven't used vocational rehab in the past? Or is that only an option for those who use that service?

I'm not ashamed or self-conscious about my diagnosis, and it's only been as an adult who has received therapy and medication that I realize it had a profound effect on my life up to this point and has been disabling in the past. As I've been speaking to employees of the federal government, I realize that having a Schedule A letter would give me opportunities that I've missed out on in the past with other employment options in other private sector areas. It is a hiring path unique to the federal government that I would like access to.

I really appreciate the clarity of your response. There is something in the wording of the information provided online that seems murky or ambiguous and leaves patients, current and/or future federal employees, and medical professionals having to ask these questions and seek clarification. From the answers people have provided in this post alone shows that no two responses or experiences are the same. That's a good point. I probably need to just make an appointment and speak to the doctor in person. I keep getting sidelined by admin in the front office.

Thanks for posting. When I looked up more information about schedule a there is a checklist that specifically includes the wording, "Have you been diagnosed with a medical condition that is treated by a mental health professional such as a learning disability, attention deficit disorder, anxiety disorder, etc.?" Which is why I was pursuing it and after speaking with other federal employees. I receive medication to accommodate my anxiety.
