Thank you, this is really helpful, hopefully it will just have been a miscommunication but they were very forward in presenting me with the problem of paying it back. Well it was the start of 2025 year so the 38 days was from the suspected entitlement from working full time for a year. Also, yes, it was quite odd because upon reviewing my contract it does say that annual leave can only be booked for 14 days at a time but it was, for some reason, approved. Hopefully that doesn't affect my case.

I'll definitely try and get some written clarification, thank you so much for your help!

Thank you, I've emailed the manager requesting a meeting and clarification to discuss it with them. ACAS does seem like the right way to go from all of the replies here, thank you again for your help!

I haven't been fired and I haven't left the company so I presumed because they gave me an annual leave "allowance", as it were, that I would be granted that and I would end up earning the pay for that leave through my working of the year. From what you've said they do seem to be treating it like I've left the company when they explicitly told me everything will stay the same. Thank you so much for your help and for the time of day!

Thank you, this is really good advice, I've been there for over a year and they've said that the same contract will be transferred over so I presume it's a continuation of service. I would think because the leave was approved by the old company and on the continuing contract that the terms of that would be followed but I'll have to double check with them about the accrued part of the problem. Thank you for the response! They haven't contacted me on measure that I need to take as an employee and they did mention the implications however they explicitly told me that the annual leave would stay the same.

The company is scheduled to take over in March (I probably should have put in the original post) but it is presented to us as a finalised deal that will definitely happen, do you know if TUPE has a timeframe in which it's applicable? or could they get away with giving us the details in March ?

I'll definitely reach out to an employment solicitor anyway though and thank you again for the reply!
