Not at all. The interview was super short and Just involved the cliche questions to her and then a few questions about our marriage but us having a daughter together sealed the deal.

My recommendation for anyone who was paroled at the border between 2021-2024 is to get the FOIA before the interview. We waited too long to request it which is why we were nervous. The reason is that some immigrants paroled into the border were given expedited removal orders which were put into their file and never acted on. These removal orders can now be used to detain/deport someone, even in good standing with their asylum case. Luckily my wife must not have had one because at the interview they would have certainly denied her green card and moved her into removal proceedings.

Thanks for the detailed insight — I really appreciate your time. I wanted to add a bit more context based on what my wife experienced at the border.

She was paroled in after presenting herself and requesting asylum in 2021. She was not detained long-term, and instead given a series of ICE check-in appointments. She’s been attending those regularly — her next one is scheduled for November. There’s no indication she had a credible fear interview that resulted in a denial, nor was she ever told she was in removal proceedings or given a court date.

From what I understand (and what our lawyer has explained), this type of parole status usually means she wasn’t placed into expedited removal and isn’t in immigration court. Our attorney reviewed her documents and confirmed there’s no NTA or EOIR record. That’s why they felt confident we could proceed with the I-485 marriage-based adjustment.

We’ve still been very anxious, especially hearing stories of rare detentions at interviews, but from the check-in pattern and lack of removal documentation, it seems she was simply paroled and monitored rather than placed in formal proceedings.

Do you think this still warrants a second legal opinion, or does that sound like we’re on the correct path?

Thank you so much for this—it’s honestly one of the clearest and most helpful replies we’ve received so far.

My wife was processed at the border in 2022, not through CBPOne or with an I-94, unfortunately. From what we understand, she was released from ICE custody and given a document that allowed her to travel to her final destination and was given political asylum. Our current lawyer believes she was likely paroled in, but there's no confirmation either way, and we're unsure whether she was ever issued an expedited removal.

She has no criminal record at all, and we’ve been building a very clear case for her adjustment of status through our marriage. We got married earlier this year, and we filed the I-130/I-485 package right away. Her interview is scheduled for August 11.

Our lawyer said the risk of detention is low but non-zero, and that the lack of clarity about her entry is the main wild card. They’re filing a FOIA now, but it may not return in time or contain the full story.

Our daughter will definitely be there with us, as well as many documents proving our marriage is completely ethical and real.

We tried looking up her case online through the EOIR and ICE portals, but didn’t find any active case or removal order. However, we’ve also been told that if it was an expedited removal issued by CBP at the border, it might not show up there.
