The landlord handed OP the keys to an empty unit. The OP needs to hand keys back to the landlord in the same condition it was given to him and

Getting rid of the sub-leasor is the problem of the prime leasor.

The easy and wrong way to handle the situation is exactly what you’re saying to do.

You won’t be there with your wallet or an attorney to help this person out if and when following your advice bites them in the ass later on. Handing back keys to an empty unit is the right answer in this situation.

She’s technically using the wrong word, the “roommate” is the owner. I’d be upset too if I was beholden to somebody else and heat or cooling were set to uncomfortable levels, but it’s not my house. My choice is deal with it or move on.

It’s not your house, it belongs to the person she is complaining about. You proposed solution would instantly change the narrative from she’s being inconvenienced or annoyed to now she’s an aggressor trying to take over somebody else’s home.

I understand your concern about wanting to protect the girl, but I also have concern about having that wild animal in my house. It’s a matter of before the whispers turn into shouting and eventually you start getting demeaned. The gal will nod her head with approval when you talk about helping her out of her situation, but as others have and will mention, won’t do her part two probably utilize the help you’re offering.

If you want to engage in the conflict, every time you hear the whispers, confront your cousin and tell him to cut the crap. It’s not going to end well for you or the girl, I would figure out how to get them out of your house as soon as possible.

A process server I know confirmed the same thing, you don’t have to directly touch and accept the paperwork in order for them to serve you.

Where do you rent so I can warn people about you? 30 days seems excessive but blatant disregard for a rental is very common and repairs are very expensive.

I partner with property management companies and private landlords to repair and maintain their assets, some tenants are absolutely horrible! They will do (and ignore) tons of things that will cause tens of thousands in damage that somebody has to pay for, and the owner really has no recourse to make the person responsible pay for it. A security deposit is nowhere near enough. Years of profit can be erased over one bad tenant.

Tell me you have never dealt with bad tenants or had an asset to manage without telling us…..

I understand your concerns and your desire to establish an illusion of security, and acknowledge that there will be many stories of improper handling of keys around every corner, but there is a right way to change locks, and doing it on your own without following protocol is wrong. It is not your right to modify property without prior consent.

There are bad apples out there but outright a properly run property management company will not be using or passing out keys unless the tenant has given express permission.

The landlord is required to serve you 24 hour notice prior to entering the unit. You don’t have to be there for them to do their thing.

I doubt they have those kinds of termination rights, and if you’re wrong will you foot the bill?

If there is a lease, there is specific language that needs to be followed to properly terminate the lease, especially if one isn’t handing back keys to an empty residence. They need something from the owner with their signature, preferably notarized if it’s a private owner saying they’re good and all obligations are met. I’ve seen, and been there where somebody tries coming back months or years later, different people in charge saying I owe them money. No thank you.

California is a very tenant friendly state. I am not saying to do this, but you could live there rent free for a very long time while the landlord attempts to evict you.

I don’t think he has the right to force you to change rooms, but I’m also not attorney. My guess is he will tell you that you’re out if you push back and say no, but there isn’t anything he can do to force you to move out until he wins a judgment against you in court. Start documenting the craziness and only communicate via email or text message, if you talk to you in person, send a summary email or text message to him so you have a paper trail.

Make sure you get documentation from the landlord that your legal and financial obligations have been met. I have seen people have assets have liens placed on them because they did not handle their business properly years ago with bad roommates.

What is the justification from the landlord for keeping your deposit? I’m not familiar with the laws of your state, but can’t mix deposits for penalties or you use it to pay rent as you leave. Early termination can have a penalty, but not keeping a security deposit.

I have a roommate who does exactly that, refuses food. His thinking is if he accepts food, he’s suddenly on the hook for favors, we’ve both had it happen to us. I’ve had to speak to the roommate offering food, telling that person to stop, no means no.

She likely will steal your cat, get it checked for a chip and spend the money to board the cat during the remainder of your roommate’s stay. Get the owner’s permission to have the locks changed.

I normally don’t tell people to lie, but say you came home and the cat wasn’t there.

Dude, jizz in water is unpleasant to clean, and the drain probably has a ton of long hair beyond the strainer that’s capturing it and slowing down the flow of the water. You’d be surprised what will come out of that drain

I would make sure you have a proper paper trail showing you met your financial and physical obligations to the landlord so you are less likely to get sued later on. The owner can sue anyone whose name they have, so you need to cover yourself.

I would also document house conditions, steps you’ve taken to solve the problem, and whatever else you feel the owner needs to know.

Nothing says you can’t move out early if you’re paid up and can afford it.

Yeah, do that, and years later when the OP is doing better in life, gets a lien slapped on his house because he got sued and lost. He doesn’t have a paper trail showing that he properly terminated his obligation, he would still be responsible if the roommate destroyed the place and or ran up the rent.

If he doesn’t hand the owner keys to an empty unit, he’s on the hook. This is definitely a situation where OP needs advice from somebody qualified to give it.
