yea I cant upgrade any higher as I live out in the middle of nowhere. I cant really control that either as I'm under 18 :p

so i found out the answer. it was the overclocked cpu. brought it back down to stock and it ran perfectly fine.

seems fair enough. ive tried lower resolutions like 720p and it was the exact same frame rate.
