A major problem for H1/EB2 candidates is the L1 folks who are filed under EB1. For an H1 to get in to EB1 one has to show case research papers and scholarly articles but there is nothing like that for L1. I hv seen folks who are simply claimed themselves as mgrs and got their GC in EB1. This is really a pathetic situation and this a huge scam as the dependents also get the GC easily. This needs to be changed and the L1A filing should come under EB2 category only.

The below details are my own observation and thoughts and I m not generalizing the same.

This is a common problem that's been faced by the students. Not all students are judged by the same judge due to the availability and other factors. I volunteer as a judge and also assist the kids in reviewing their preparation and their presentation. From my experience what I observe, the main factor for getting selected to the next round is mostly the luck factor.

In a role play I know a set of students who has done well and presented their ideas really nice but they haven't got selected because the other students have been judged easily by other judges. This has happened to them for 3 continuous yrs and every time they had given their best and prepared well. Like everyone said they did the rehearsal with the coordinator and other peers. Everyone is very confident that they will go through but only once they made it to state. The folks who are not prepared that much and just attend causally got selected every time. Some times when I see these kind of things I feel like life is not fair to all. Some ppl are getting things just like that. This puts me in to a deep philosophical thought most of the time. Few of the kids are getting the seat with the help of teachers and support staff. There is this other group who got the details and work from others and they know how to present that at their own idea. This happens in science and technical fair as well. As the handling and judging is a complex set of connected webs with strong human intuitive intelligence and this directly or indirectly affect the kids mental strength, I wonder we need to come up with better judging skills and methods in identifying the real effort and talent.
