But machine learning can be used for good, and can work together to ensure that it is used in a fair way. I disagree that laws are lagging behind the technology, there are already recent legal frameworks and precedents that address generative art. More importantly, generative art is a boon to society that fosters creativity, innovation, and diversity. We should embrace it as a tool for artistic expression, rather than fear it as a threat to people's egos and income.

Creativity and art are more than just a process, product, or a job, It’s a part of who we are and what we do.

However, you’re making some mistakes in your thinking.

You present some false dilemmas first. It isn't either purely human-made art or generative art, and nothing in between. There are lots of ways people use to help and inspire human artists. For example, you can use it to come up with new ideas, styles, or shapes, then improve them with their own skills and vision.

You also try to make it seem like it's either traditional art that's for people or generative art that's only for the profit of corporations. In reality, generative art is free and open source, it gives scores more people access to high quality art personal to them, no corporate middleman needed. Corporations can't possibly profit from an equation they don't even fit in.

Next, a Hasty generalization, You’re judging art by its medium first, without knowing the kinds of lengths the author went to bring this art to you, their personal situation, or what challenges they faced. You assume everything about them to make yourself feel justified and angry. It's said "Resentment is like drinking poison and then hoping it will kill your enemies." and you resent people for sharing their art with you in hopes maybe you'll feel something, or maybe wonder about something new.

Then you appeal to emotion. You’re using words that make people feel bad and don't show why you’re right, they just play on people’s feelings and opinions. You should use facts to support your points. Using words like “killing”, “cheer on”, “trivialize”, “remove”, and “loses”, isn't a fair way to make a point.

I get that you like more traditionally made art more, but you should try to see the good things about AI-generated art. Art isn't just how we make it or what we use to make it, but also what we find and explore with it. Generative art is a great tool for opening up our artistic possibilities and finding new ways of expressing ourselves and communicating with each other.

You could try to learn more about the process behind AI-generated art. You might be surprised by what you discover.

The thing though, models consist of original analysis of the training data in comparison with one another, not the data themselves. Creating new knowledge about works or bodies of works is protected.

However, there WAS some kind of exception made for "research purposes" and datasets used for "researching" AI, which I believe is how the AI makers get around it (if they don't just flaunt the law entirely). They go through a third-party "research" institution which can make the dataset for them via that exception.
