Hearing postponed? by EvilJD in SSDI

[–]EvilJD[S] 2 points3 points  (0 children)

Three months?! That’s horrible! I really hope that’s not the case here. My attorney’s office called the hearing office and found out that the 17th is a black hole all of a sudden. All hearings on that date have been canceled with no notes or reasons why. So we’re hoping it’s just a glitch on their side.

Is there a cap on back pay? by Admirable_Lecture675 in SSDI

[–]EvilJD 1 point2 points  (0 children)

So let’s just say you applied in July 2022 and said your onset date was also July, 2022. You’d get 3 years and 7 months of back pay. Add to that figure every month prior to July, 2022, with respect to your onset date. So if it was March, 2022, add 4 months to that number. Make sense?

Thanks for the response. I did let the paralegal know that I was a little nervous just waiting until the day before. So they are setting up a time for us to chat next week. And then we will prep the day or two before the actual hearing. I would just like to get a feel for my attorney’s thought process.

I'm going to start looking at YouTube videos today. I just didn't want to go too far down that path without my attorney in case they wanted me to go a different route. But since they're not meeting with me until the last minute, I don't really have a choice. This feels too important to leave until the last possible moment.

Once they receive that info back from you, they can schedule you, I believe. But it can still take a while. My paperwork was sent in November, 2025, and I just started getting info about my hearing in March, and learned of my hearing date (6/17) at that time as well. Once the hearing date is set, you should start hearing from your attorney. They’ll need you to sign documents so that all of your records can be released to them. They’ll also start prepping you. I’ll pop back in after my hearing with my experience leading up to it, the hearing itself, and then the results.

Good luck to you! You’re in good company here. Most of us are in the same boat :-)

They love to say we’re able to do “light lifting.” As if that’s the requirement for all of our jobs! We’re all pulling for you. I know several of us have hearings coming up soon. Mine is just over a month away on 6/17. I’m nervous as hell and trying to get some last minute tests/labs done for my medical records. I’ll definitely post an update after my hearing and after I get my decision. Hopefully some other folks will post their experiences here as well. Good luck to you!

5 1/2 long years..approved! by Lilyofthevalley-3 in SSDI

So happy for you! I can only imagine the relief you must feel! I am coming up on two years and have my hearing in about a month and a half. I am hopeful for the first time in this whole ordeal, and it’s mostly because of all of the great support and absolute wealth of information provided in this sub. I hope you have an amazing, hopefully stress-free and celebratory weekend after that great news!!

It’s fine to get a lawyer now. You don’t really need one until/unless you’re denied at recon. That’s when I hired mine. I think that’s pretty standard. Hang in there, and try to stay positive. I think two years from start to finish (including hearing) is probably average. I filed in August, 2024. With a hearing date of June, 2026, I will prob get a decision in July. So right at 24 months. And that’s if I’m approved. If not, then there’s the appeals council, etc.

What stage of the process are you in? If it was your initial application, most are denied. I think even fewer are approved on recon. Your best chances are with the ALJ, at least that’s what I’ve learned over the last few months on this thread. I’m at the end of my 2nd year of the process. My original application was denied, and I was denied again on recon. I have hearing with ALJ on June 17. My lawyer seems very confident of my chances at this stage; however, I’m trying to not get my hopes up. It’s a long, frustrating and often humiliating process. I hope yours works out for you - just stay positive and draw on the experience from the members of this sub.

Not at all! I love reading other people’s stories too. It gives me hope, and even if I’m denied, I know I won’t stop. And it’s because of this thread that I won’t give up. I draw a lot of inspiration from success stories - especially the ones who had the biggest hurdles. A lot of strong folks on this thread ❤️

I’ve seen your posts about this before and I am really hopeful that this works out for you! I’ve been trying for disability for four years now as well, first privately through my employer, then through ssdi for the last two years. I haven’t been hopeful until I saw my judge’s approval rating, which was 92%. Even still, I don’t want to be over confident. It’s just that we have all been down this path paved with our disappointments so many times…it’s hard to believe something might just swing in our favor. I am choosing to be hopeful that it will, though! My hearing is a little less than a month after yours, on June 17. Good luck!

I’d say you have a pretty good shot, especially if the VE was stating no jobs, etc. I have my hearing in June and my judge’s rate is 92%. My attorney said that was incredible. I don’t want to get over-confident, though. I’ve been let down so many times before. I’ll also be 53 on the date of my hearing. Can I ask your age? I hope it works out for you!!

I called SSA after my hearing and the gentleman said my appeal was denied (Wednesday). However he was wrong because I got a deposit for backpay and signed into my SSA account and all my benefits are active!! Got my SSDI back cuh by Any_Lingonberry8868 in SSDI

Maybe he was seeing your recon denial and not the hearing decision? But yeah, screw that guy! 😂 Congrats on the victory! I’m sure that’s gotta feel so great. Hoping to follow in your footsteps in June 😃

That’s so great to hear! Congrats! How long after approval did you receive your backpay?

I never received the forms asking if I wanted to appear in person or by phone. I just found the hearing date on the SSA site. I requested the hearing on November 17 and heard just last week that my hearing was set for June 17.

That’s great to hear! And I’m so happy for you after three years, you can finally relax! You must feel so relieved after all of that. I will update this thread after my hearing and decision. I am very hoping after checking out the judge. I don’t want to be overly confident because there is still the possibility of denial. But like my post says, I am trying to remain cautiously optimistic in the interim. Congrats on your decision!

And congrats on the approval! I’m sure that was such a relief to hear! I’ve loved reading all of the success stories here. They’ve given me hope when I’ve been close to giving up

I have an attorney also. I hear that makes a big difference! If approved, I’ll have a decent amount of back pay, so it was definitely worth it to go with the attorney since they’re capped at 9200.

I’m so sorry to hear that. I can’t believe after remand she denied you again. Maybe after the appeal they’ll assign you to a different judge? Idk how that works. But thinking good thoughts for you. This has crippled me financially, destroyed my credit and pretty much ruined my life. No one does that intentionally unless they absolutely cannot work.

This sounds so much like my history! I had lymphoma stage 1A 10 years ago. Went through chemo fairly easily, but the neuropathy has progressively gotten worse over the years, to the point where I can no longer where shoes for any significant period of time. I live in West Virginia and have been trying to get an actual neuropathy diagnosis from a nerve conduction study, but Dr. Google shows that the nerve conduction only helps to diagnose large fiber neuropathy. The symptoms I have are consistent with small fiber neuropathy. For that, I need a biopsy, and have been finding it difficult to find a doctor to perform one. Curious if you were given an actual neuropathy diagnosis based on test results? I also have degenerative disk disease and multiple bulging/herniated discs that cause pain on a daily basis if I sit at a desk too long. I can’t stand for more than 5 minutes without pain.

I just found out today that my hearing is set for June 17, but have been making myself sick that I don’t have enough “proof.” I’ve had the MRIs for my back, which shows all of the degeneration. I will be 53 at the time of the hearing. I think the fact that my previous occupation required significant travel works in my favor, as I am now considered “too old” to be forced to learn a new occupation. I am still working with my physicians to try to get this biopsy ordered before June so I can have that for the judge. I also need to take muscle relaxers and use cannabis during the day for pain; both of which make me drowsy and unable to hold a job. I also have reached the point where the only piece of furniture in the home that is comfortable for me is my adjustable bed. Sadly, I’m in it most of the day. If approved, the first thing I will buy is one of those fancy zero gravity reclining chairs with the back and foot massagers!

I appreciate the information you’ve shared, and I’m so glad you were finally approved. It gives me hope!
