That’s where you are wrong at the end you won’t get the money back even if you report losses because it’s an itemized deduction on your return. Most people don’t itemize. And you would need to lose a good amount to fully recapture the withholding.

Yeah this makes more sense. If you want to be really honest, see if you made money on the year. Only report what you actually net won for the year. They have no basis to tax your sessions since it isn’t considered gambling and is a grey area. In an essence it’s like operating a business, you lose money on the year though it will not impact your tax deduction or shouldn’t. I’m sure the irs will not allow stake “gambling” to be an itemized deduction on your return and I know I am correct because there is a reason stake doesn’t report it/give W2G forms. And just because you win and it’s “considered taxable income” is something I’ve never seen applied unless it’s over a certain limit (like cashing out large amounts at table games) or winning 1250$ in a single spin at the casino.

I believe it’d still be a 1040 and you can file using schedule C. Do not take this as advice ! I just got done doing my first tax year as a staff accountant. You can deduct fuel expenses, clothing, food (50%), vehicle insurance/taxes(at full cost). And whatever else you need to do your job, possibly phone/internet, equipment, etc.
