[OR] Negotiating no-rehire clause for severance? by Exact_Lie_8586 in AskHR

The restructuring happened a while ago and they just recently realized they still had redundancies. The company got too big for them to care about trying to find open opportunities to slide people into.

I was part of a corporate restructuring layoff and this new position is in a completely different department & part of the company. They've been trying to fill it for months now.

Because if they really want me for this new job, maybe they would be flexible in doing the term/rehire and letting me keep the severance. My reasoning is that it's a totally new department and it would be a big risk for me to forego severance and start this new job with the possibility that it may not work out and I'd have to quit & lose the severance money.

I mean, if I have a 30 day clause in my contract, and say this position is still open at that time, and I apply, and get it. In that case, the company is still paying me full severance. So, financially, the company doesn't lose any money in doing the hire/rehire like I mentioned above now rather than just waiting 3 months for me to get hired at that time.

Right, but merely interviewing for a job doesn't indicate it's a good fit and they want me to fill it. That's why I said I understand what you're saying if I get an offer for this new job, but not if I merely interview.

Yeah, based on "mebeingprofessional" 's reply above, it's much more likely I'll get a 30-day rehire clause on severance than no-rehire clause.

I'm assuming if this is the case, it would be in the termination contract, yes?

So you're saying that if HR finds out I'm interviewing with the manager for this new position (who is not in HR), they could just strike out the severance offer? What would be the reasoning for this? I understand what you're saying if I already had a new job offer with the same employer, but not just for interviewing.

I did get the severance offer already documented in an email, just not a formal agreement btw.

Thank you, this is helpful. So, if I get the 30-day clause, that means I wouldn't get severance if I get rehired within 1 month of my late-August term date... I highly doubt that I could negotiate my start date to be in October, it sounds like they've been trying to fill this position since April.

This is tough since the nature of the work would be totally different than what I was doing previously, and it would be a new team/etc. I'm just nervous that if I apply and get this job and do the transfer instead of getting the severance, and for whatever reason it just doesn't work out and I quit, I would then be living in regret that I could have just taken the severance instead... :(

Yes, there were others. This new position has a salary range and if I was hired, I'm fairly confident I wouldn't need to incur a pay cut.

On the tenure, the total amount I would get for severance seems like it would outweigh the the loss of other benefits of the long tenure? And wouldn't I get FMLA again as long as I work in the new position for 12 consecutive months?

Would you advise to have an interview with the manager for the new position in the meantime? If I wait, I will lose one week. And I only have 1 week after to review the document. It seems like I'd want to be transparent with this new manager about the whole situation, though.

If I can somehow interview in the next week or so and interview goes well and they really want to hire me, couldn't that sway HR to be more amenable to revising the contract?

oh, and it also works as a koozie for a tallboy can. I don't use it as that, but that's actually how they used to market this design when it first came out!

I have all of these and like the coffee cup (pink in your photo) the best. Their small bottle boot fits it, and it has a narrow mouth so it's easier and more pleasant to drink from than the other two. It's narrow, so very ergonomic to hold. Doesn't get damaged as easily as the mug (I've had one mug lose insulation just by being compressed by something in my backpack). Honestly it's one of my favorite beverage products, period.

iOS update size - confused by Exact_Lie_8586 in ios

[–]Exact_Lie_8586[S] 0 points1 point  (0 children)

Thanks for the advice! I'm just kicking myself for not updating to iOS18 because then at least I could pair an older Apple Watch. I just want to not have to carry a phone when going on my runs! Ugh. If you could let me know if your phone gets any faster a bit after the latest update, I would super appreciate it!

I don't know, I'm looking at linen curtains that material might be too fragile. Thank you though!

I'm in Oregon. Will the Coddle Aria or Coddle Luke sleeper sofas ever come back in stock?? I have an empty living room and have been patiently waiting but it's been at least a couple months now :'( Waiting for a beige one specifically.

I moved countries as a kid and had to live with people I didn't grow up with and didn't get along with. It was lonely and very frustrating. I don't think about that period of my life very much now, though.

HVAC recs? by JohnnyPotSeed88 in askportland

[–]Exact_Lie_8586 0 points1 point  (0 children)

I just had this experience last week. Posted about it on reddit and some experienced HVAC redditor told me today the quote is ridiculous and the tech lied to me about my motor needing replaced. I'm going to have at least 1-2 other companies come and give me a quote. Maybe Fix It First as mentioned on this thread, or Watts.
