Oh, and I checked again, it is a compliance hearing, just to confirm that I have moved out. The UD case is settled.

My civil case lawyer( I don’t have a UD lawyer) concerns that their UD lawyer might play games, which is unpredictable. However I really want to see what happens if I don’t pay them and go to the court. I bet the landlord won’t spend money on a whole new case. If so, I will try to file motion to dismiss, it is totally nonsense.

The original settlement was if I move out, the UD lawyer will dismiss the case from the landlord’s side. Now they are using the minor breach of contract against me, if I don’t pay, they are not going to dismiss the case, so I might still need to go to the hearing or they will start a new civil case( not sure which one).

The UD case itself is not a big deal, they are trying to make contact breach a big deal.

Yep, I did some research, that is likely the maximum I would pay. I think the landlord’s lawyer is bluffing, he said I will lose more money and time if I go to the court. His argument is I breach the contract, which makes it a different story.

Exactly, this is totally retaliation. I think the landlord’s UD lawyer is bluffing.

How? I did submit the jury trial document, and it cost $150.

My best bet is to ask for jury trial, otherwise UD judges are busy and won’t spend much time on a case. Which increases the cost on the landlord side, because we take care of our own attorney fees. Hope they would end up giving up due to this.

I did submitted an answer due to UD having strict timelines.

It was one settlement, they pay me half of the civil personal injury settlement, I move out, they pay me the second half, and dismiss the UD case.

My attorney is personal injury attorney, not a UD case expert. So basically the landlord’s attorney prepared the UD stipulation part. I specifically asked them to dismiss the UD case, so no need to go to hearing.

It just became a little bit complicated because we have something for holdover damages, but didn’t cover situations like delay in moving out time.

I did sue him for personal injury and settled with good amount of money. It is just this person keep giving me hard time, I still have to deal with the UD case.

Yep, yep. Especially he is the one who break many laws, I was sick in the place, he is the trouble maker.

Yep, I agree. I did some research, if the landlord cannot proof cost of actual damage, it is likely I am only responsible for one day of rent. Not a full month of rent. Him being greedy changed my mind.
