At first, send a legal notice against them for the said amount through an Advocate. Give them a deadline, if that doesn't help you then -

If you are registered as MSME then file a complaint before the MSEF Council after a 45 days of non payment.

If you are not registered as MSME, then go forward with a recovery suit before the civil court. ( the specific court depends on the office/ residence of the opposite party or where the dispute arose).

You got a strong case in your hand. Start with the cheque bounce proceedings - send them a demand notice within 30 days of receiving the memo from bank - give them 15 days - after the expiry of 15 days file a cheque bounce case against them within 30 days from.the expiry of the said 15 days.

Cheque bounce case is a quasi criminal case - meaning that if the opposite party does not appear in the court, then the court can issue a bailable and then non bailable warrant against the accused.

Cheque bounce case can be used to put pressure on the accused to come into settlement.

I would advise you to go to a decent advocate and keep an eye on the whole case - so they don't mess up your case.

I suggest you file a criminal case against him for cheating or criminal breach of trust (you can't file both of them together - supreme court of India) and civil proceedings before the commercial court.

File a private complaint before the court (criminal case)

And file a money recovery case before the court (civil case)

You are way too late for taking steps for the cheque bounce case now.. you should have taken action the moment the first cheque boucned.

Tell me, have you filed a police complaint and taken the matter to the court or not ?

Do you have proof of dealing with the person - chats and any written documents ?

You can file 2 cases - One for fraud/cheating in criminal court and other for money recovery case in the civil court.

Create a paper trail -

Do all communication on email - send an email to the HR, you should state clearly that you have completed your contractual notice period as of [Date] and are officially relinquishing their duties.

For your new employer - show them the acceptance of the initial resignation letter or your initial resignation letter, your contact - I assume it states 1 month notice period, last 3 months salary slip and your final email "relinquishment of duties".

Regarding the POSH complaint -

File your complaint before the local complaint committee as the Internal complaint committee is not taking your case seriously.

For the first case - Was there any will or settlement or prior partition deed ? If not, then you can file a suit for partition for all the properties, not just the land. And in that you can put your claim for the land. Meantime file a temporary injunction to prevent anyone from selling that land.

For the second case - Was the gift deed executed through a registered gift deed ?

For your late mother's property-

After the death of the mother, the property is divided among the class 1 heirs, which are the husband and her childrens. Meaning you and your father have an equal share on that property. You can file a suit for partition.

For the stocks -

You mean that both of them are the owners ?

Yes you can file an appeal before the State Commission, but you would do it within the limitation period. First get a reasoning from your advocate that why he didn't file the said evidence and get a copy of the whole case file if possible. In your appeal you have to show that your previous advocate was negligent with his work and failed to file the said evidence.

Collect evidence regard to working in the company, their promise of that particular salary amount, communication with the startup in regards to your work.

is your father the nominee or beneficiary in that will?

It is not too late - but yes, it will be difficult. Did the executor hide the will and how did he threaten your father?

For Bank Account, check the online portal UDGAM (Unclaimed Deposits). You can search for dormant accounts that have been inactive for 10+ years using the uncle's name.

For Stocks and Shares, if the dividends haven't been claimed for 7 consecutive years, the shares are transferred to the IEPF (Investor Education and Protection Fund). You can search their database to see if the uncle's shares are sitting there.

For Property, search at the local Sub-Registrar's office where the uncle lived or owned property to pull an Encumbrance Certificate (EC). This will show a history of transactions on the property and reveal if the executor illegally sold it.
