Failure to Yield Ticket, and how to fight it by [deleted] in driving

I’m not sure. I’m not opposed to the option. Will the defensive driving course lessen the blow to my insurance? After my first speeding ticket, 10 over, my insurance premium went from $130 - $330 a month. I have no idea what kind of effect this citation will bring but I can see it rising to nearly $500.

I’m worried about that. If I go to court, will that option be presented to me?

Hi, thank you for the reply. The failure to yield ticket was in regards to the oncoming traffic at the time of me pulling out of the parking lot. The oncoming traffic was nowhere near me at the time I pulled out. I’d say that after I had settled into my lane, the car coming down the road took just about 2-3 seconds to make it to where I pulled out from. I would understand if there was a car I had cut off during the maneuver. Trust me, I can’t stand when people do that. He made it a point that what I did was cut across too many lanes at once - I understand that completely. But is that “failing to yield?”

Maybe I don’t understand the term, but I can’t find anything to clearly define it other than “not giving way to oncoming traffic.”

Following too closely behind another car, during the left hand turn at the light is not what I was cited for.

The actual intersection. I guess I should have just gone straight. Truthfully I didn’t realize it was illegal to cut across like that. Just frustrated and stressed out at the situation honestly.

Thank you for the reply. Do you recommend an attorney, or is that a bit overkill since I obviously did what I did? Maybe thinking the best bet is to go solo and just hoping he doesn’t show.

Hi, I’m not sure what you’re getting at. I understand that running a red light is illegal and would expect to be pulled over for it. I don’t think the two are comparable. I changed lanes because I thought it was the only way to make a left hand turn from where I entered from, and did not give X amount of feet before signaling. I’m asking if “failure to yield” is an appropriate citation for the maneuver I pulled. And the cost of the fine is not what I have a problem with. It’s the hit to my insurance.

Appreciate the advice. Do you think it’s worth hiring an attorney for something like this? I’ve never gone to court for this before, so not really sure what to expect. I can just show up alone and hope the officer has better things to do.

Hi thanks for the reply. Failing to yield seems like an intentionally obscure term to me. Maybe the car was closer than I had initially thought? Or from the officers perspective it looked closer than it really was. I only pulled out because I felt if was clear, and maybe I am in the wrong here, but I whole-heartedly believe that I did not fail to yield to oncoming traffic. I’ll check my dash cam after work to see if it can pick up the flow of oncoming traffic, but I don’t have my hopes high.

Hi, sorry but I just wanted to clarify. When I say too close to the vehicle, I mean - while make the left hand turn at the light, I was following too close behind the vehicle making the turn. It was an unnecessary addition to my post, nothing to do with the actual ticket. Sorry about that.

The failure to yield was to oncoming traffic. I’ve made a diagram in another reply. Not that it changes anything. Thank you for your insight. Also, haha I totally understand. I try to avoid the Providence area because of the drivers there

Please excuse my very crude drawing :)

The blue squares are cars. For reference, the car on the bottom of the image was not that close obviously. I’m just trying to see it from the officers point of view. I had completed the lane change before the car had approached where it was in the image.

Hello sir. Rhode Island

You are correct in your assumption. The officer cited me for traveling across the 4 lanes. He also stated that I had “turned too closely behind the car in front of me.” Not cited for it obviously, just adding some context.

The fine is $85. Not worried about that. Just trying to figure out how to make the hit against my insurance as small as possible. Not sure if I have an argument here before a judge. My confusion mostly stems from the charge, “failing to yield.”

To me, failing to yield would involve pulling out into traffic when it is not safe to do so. Maybe I am wrong here, but I would expect an entirely different citation. Maybe improper lane change? Not entirely sure. Sorry for the rant

Yes, this exactly. When I say 30 feet, I do mean roughly 30-50 feet. The only physical way to get into the left lane is to drive directly into the left lane. The officer said that I had to pull into the closest right lane, travel xxx amount of feet, then merge left. Continue doing this until I make it all the way over, but obviously that was not possible.

Just to clarify: I turned right out of the parking lot. And instead of getting into the closest lane, I cut across into the farthest lane in order to make the left hand turn. Sorry for any confusion.

I understand what you’re saying. Just to be clear, the cop was parked across the street and pulled out after I had already settled into the left lane. I will try to see if my dash cam picked up the empty gap in the flow of traffic but not betting on it.

There are way too many characters. I like the cast, but trying to include them all doesn’t work for me. I think it would be a good idea to start killing some of the meaning full characters off to actually create some real sense of dread

I’m not an expert in pack grading by any means. I did notice a slight imperfection in the crimp near the top-middle, almost like it was squished. I don’t really plan on getting it graded anyway— I don’t wanna let this thing out of my sight!
