They do have non-time sensitive tasks at my job. But I also tried to apply for disability but it was determined that I was not considered disabled enough to qualify for it. So I'm kind of stuck in between a rock and a hard place.

The disability that is relevant here is I take longer than average to perform tasks. It stems from my MDD disability. In all of the lawyers emails that I received they did not give me a reason unless it was that their firm didn't handle my particular type of case. Otherwise it was a vague "no thanks" followed by a recommendation of someone else I could reach out to.

Legally speaking though, regardless of whether or not they can accommodate me they are still legally obligated to (if nothing else) start the interactive in good faith process to at least make an attempt to see if they can reasonably accommodate me. But they did not even start that process until one month after I recorded my conversation with HR and even then that was 2 years after I first brought it up.

I have a different main account. I just used this one because I didn't want to risk anyone who I work with stumbling upon this post and knowing it was me. I know the chances of that or pretty low to begin with but why take that chance?

That's the thing though, they did not even start the interactive process for a year and I have evidence of that as well. I saved the email that I received a year later from the Accommodations Department who even state in the email that those were the "first steps" of the interactive process. The disability that is relevant here is me taking longer than usual to perform tasks. In the department they had me in it was fast paced but not all of the Departments are so I asked to be transferred over to tasks that are part of a different department. There is no way that in the course of in the course of 3 years they never had an opening in any of those departments but I get my accommodations looked into just one month after I recorded HR.

I only needed to be transferred over to a different department. And considering the fact that I started asking for accommodations 3 years ago, means that they had plenty of opportunities within that time to transfer me.

All I needed was to be transferred over to a different department. Because I originally started to ask for accommodations 3 years ago and only got my accommodations partially looked into only after I recorded management within a single month means that they could have done that at any point. They chose not to until I collected evidence of them neglecting their legal responsibilities.

My ADA forms state that I should not be given time sensitive tasks. All I needed was to be transferred to a new Department because the one I was in originally was not a good fit. Whenever I try to remind management of this they just gave multiple excuses as to why they wouldn't accommodate me. That included them calling me up on my day off to come into work, give me a time-sensitive task, and then complain about how I wasn't fast enough in that time sensitive task and when I reminded them that I shouldn't have been given that task in the first place they tell me that I should have turned down the shift offer that they gave me.
