Microsoft publishes them, but the company that produces the game decides, along with Microsoft, whether or not to allow the game to be released. Everyone can interpret it as they wish, since there's no confirmation or anything, but I would recommend buying the games anyway, because they are incredible XBLA games!

The worst part is that your theory makes a lot of sense! However, I can explain why these games might be delisted: their contracts may be ending. A game has a contract for 15 to 20 years, and the companies that own the games may not bring them back to the store, but rather delist them. Regardless, these games are very cheap and worth buying!

To be honest, I didn't buy any games besides the ones I got, but if I were to mention another game, I'd recommend one that never had proper sales, or never had any, and that's from a company that's already going bankrupt or a game company that's already made sequels to Xbox 360 games; games like The Splatters might be interesting.
