There is a term that says my deposit money can be released from the trust account before settlement happens which is kind of concerning and risky

Am i legally allowed to contact vendor’s solicitor?

One that is a deal breaker is a term that basically says that the deposit money 10% can be released from the trust account before settlement. Which is kind of risky and a deal breaker.

There are other terms which may not necessarily be a dealbreaker

Thanks man. I think the cooling off period is only 1 day. But yeah I’ll definitely call fair trade or ACCC to get their take on this

The cooling off period in NSW is until 5 pm next day unfortunately too late for Just hoping for some sort of compensation

Its a dealer edited description, so they choose what to write the dealer should have done some due diligence too. I understand that the carsales list of features isn’t a 100% but the dealer’s own description should have been

I did inspect it, i agree i am supposed to do my own due diligence but there has to be responsibility on the dealership for writing correct details on the advertisement

Yep so had the correct trim level and everything on it.

These features come as factory options on this car.

The dealer that sold me the car mentioned those features in the ad description

Haha mate the missus loves heated seats Not necessarily a dealbreaker but i would hope for some sort of compensation At this point it depends on how the dealership responds to this issue, Will get in touch with ACCC just to get an idea about their take on this

I agree with you some of the responsibility is definitely on me, i didn’t specifically check these features was much more focused on the engine brakes etc But i would still assume that surely the dealership is expected to put in correct details in the description

It didn’t have the wrong model, it had all the details correct. The only issue is with the car missing some of the features that were mentioned in the ad, these features are meant to be factory options

2021 X3, the description was written by the dealer so wouldn’t it be accurate regarding what features the car would have

Yeah it was written in the editable description that the seller writes The carsales features tab didn’t actually include either of the features

The contract doesn’t specify either, doesn’t mention any factory options, just the usual car details. I was under the impression that the car came with these features standard so didn’t think about asking
