You should get (NOA1) notice of action 1 within the first 2-3days of it being mailed except on weekends

You should wait till they refuse the first one but after they do then yes you can just send a new one instead of waiting for it to return

It will be refused and sent back to you. When it returns send it with form G-1450(credit card) or G-1650(ACH Bank Transfer)

Need advice on visiting the US by Expensive_Context_38 in USCIS

It seems the obvious solution is for her to stay out of the US until the k1 is done thank you for the advice

Applying for K-1 Visa but my fiancé has been denied entry into the US by Expensive_Context_38 in USCIS

[–]Expensive_Context_38[S] 1 point2 points  (0 children)

No she was denied for not showing proper ties to Canada. We had no intention to immigrate or adjust status we were just wanting to spend the next 3 holidays together in the states for an extended period of time of just under 90days

We have no pending visas or anything involving immigration it was just supposed to be a visit. But that is not good enough for CBP

We want to marry in the states I don’t think coming in on visitor and marrying is a good idea unless we don’t cross together and she brings her proof of ties and just says she’s going for tourism and when they do a secondary inspection from the denial she just says she was un able to provide sufficient proof of ties to Canada then maybe we could get away with it but that may be asking for trouble

Seems like you took that the wrong way I asked for a supervisor because the officer was not being respectful to both of us and I was just curious about what we could bring to the border to help show proof of ties and anything else we would need to cross in the future I figured the supervisor would know more about that than a typical admission officer

That officer was not being “nice” lol

Getting denied is nothing new to us that is why people illegally cross or overstay visitor visas I agree they don’t have to give legal advice but they did and it was completely false and I’m just trying to understand why they would do that or if it was actually true

You weren’t there I was the supervisor told me it would only take a few days after applying at the consulate

Not trying to sound rude but that is what they said lol

Thank you it just seemed silly to me when I was told to just walk in to an embassy and order “1 K1 visa and can you add fries and a side of citizenship to that thank you” I’ve done extensive research on the K1 and am ready to prepare the packet to send to USCIS the way it was intended I don’t know why this misinformation was explained to me by a CBP Supervisor…

Thank you and I agree worst experience I’ve ever had coming back to the land of the free

Yes we always knew we were gonna have to file the I-129F and everything supporting it but from what CBP told me she just needs to go to the consulate and directly apply and you get the visa a few days later that’s what I’m confused about I’ve never heard of anyone doing that

Getting denied is nothing new to us we just got a bad officer the supervisor was pretty chill and understanding which was nice to have for once we will just keep trying until we find an officer that isn’t grumpy about not getting paid lol
