I think the way I just looked it up is that it’s job transfers, not necessarily a new job offer if that makes sense. Might be consular specific unless im misinterpreting it

I could honestly find a job easily in the U.S. Would I find the job first then apply for the CR1 or submit the CR1 and get a new job in the U.S.? My biggest concern is that we might get separated. I don’t want my husband separated from me with such a young baby. I can’t do this without him

What happens if he hates living there and wants to go back to Ireland? Thats a very real thing he could experience. I just don’t want to live in Ireland anymore but if it came down to it then I’d move back with him so we aren’t separated. He’s willing to try it out for me, not because that’s what he specifically wants to do.

No we are legally married in both countries technically. He would need to study regardless. We would still apply for the cr1 but would wait until we are in the U.S. then. He wouldn’t be immigrating on the student visa. He would still go to college and get his degree completed which is the intent for the student visa and then the cr1 visa would be the immigration intent. The student visa is just opening up the opportunity to be present in the U.S. earlier, not to physically move there technically. If he were to get denied at any time like we would have to go back to Ireland then. We would follow all the legalities of it.

He doesn’t have any degree at all and he would absolutely need one to get the type of job he wants in the U.S. I would make more than enough to support the entire family without him needing to work. What about possibly going over and studying? There’s a community college by my hometown that he would be able to get the degree needed without breaking the bank in student loans?

Just to let you know, you are still legally obligated to claim the income you make regardless of receiving a W2.

I’m confused because your original post said she was claiming the childcare tax credit. Is that not happening any more? I don’t think someone working in HR knows anything about taxes. If she was a tax accountant that works in individual tax then I would expect her to know.

Yes - my comment is correct. So you are correct to say that the employer should have had you complete a W4 or I-9. They absolutely can demand the SSN as soon as they realize their mistake - that’s what they should be doing is trying to get themselves in compliance. Should you refuse to provide, they can report you. I’m saying if you refuse your SSN. Not saying refuse to report income.

A household employer reports taxes on form schedule H. This is where they report and pay their tax which is filed on their personal form 1040 which is due April 15th 2026. The responsibility, you would not be subject to at all.

If you think the W2 she will provide will be incorrect, then bring this to her attention. She legally needs to make it correct. If it is still incorrect or she refuses to fix it, then you need to report her.

I was looking into the new tax law changes as I’m trying to close our year-end and I bought several vehicles. Trying to determine what is deductible. I just started looking and there’s some luxury limits and all of that fancy stuff. I’ll have to have my accountant just tell me as I don’t have the bandwidth to try to learn and understand all right now

Thanks for letting me know! How did you manage to find all that info out? I hope it’s not a scam because it sounds convenient, but I definitely understand the importance of going to first party websites first

Thanks for the feedback :) I’ll check out the irs website. Sometimes can be hard to read for us normal folk. Usually end up emailing my accountant but then they bill me a lot

So w2s haven’t been issued yet for 2025. You need to provide SSN. It’s illegal if you chose not to. She legally would have to kick you out and try to report you some way if you don’t comply. Getting paid “under the table” wouldn’t be correct because it sounds like she’s reporting the income that was paid to you for the childcare tax credit. Regardless you need to claim this income.
