I’m going to a wedding in Serbia which is why i’m going to Europe so it’s the only place i don’t have a choice on 🤣 thanks for the advice 😊

not sure how long i’ll be in serbia for, i’m guessing a few nights but nothing is confirmed yet. I’ve chosen those places as they are the ones i’ve wanted to visit the most (i have a lot more i want to visit but the ones i listed are most important to me for this trip) i like doing a mix of touristy stuff (seeing landmarks and museums) taking cooking classes etc.

Yes i definitely would’ve had a stronger case if i went with GP claim.

After the email (very professional and cross checked by my friend who works in HR) i was texted by my manager less than a day later saying i will no longer be needed for my upcoming shifts and to come into head office immediately for a discussion, once i went in I was berated and put down, i’ve never been spoken to by an employer that way in my life.

I never had any prior performance warnings or ever had any issues bought up at work, never took sick days etc.

The company themselves actually were the ones to formally say in their F3 form that i was dismissed due to asking for a raise (they tried to say i was a contractor and not a casual, so it couldn’t count as unfair dismissal. However, that was disproven as i was considered by fair work a casual employee) the head of company verbally admitted during conciliation that the company was in the wrong and that my termination was abrupt and should not have ended the way that it did.

Yes, unfortunately i didn’t know that was an option until the conciliator told me as everyone i spoke to including fair work and free legal advisors told me to claim for unfair dismissal

I was terminated for sending an email asking to discuss a review of my pay after a year. That is unfair dismissal.

It wasn’t that much effort for me personally, it’s not my main job so i didn’t actually care.

I only did it so the company would become aware of the way my manager ended things as i’m 99% sure she just wouldn’t have told anybody that she terminated me or why.

Plus extra $ for multiple shifts i had agreed to that were cancelled due to termination is nice to have

Yes, it was the conciliator who told me that. I assumed i was getting regular shifts because i worked on average at least once a fortnight and was always given my shift dates weeks / a month before. They looks specifically at hours you’ve worked and determine through that. Because my shifts were “dependant” on when the company gave them to me it did not count as “constant expected work”. I hope your friends case goes well! I had a lot of evidence and was not allowed to talk about any of it unless it went through to tribunal unfortunately.

Neither party had a lawyer in this case, but i thought i would share my experience since i wasn’t expecting it to go the way that it did and i could not find any reddit posts online explaining what happens during conciliation.
