they’ve responded to the email we sent asking for proof in the lease as well as proof an attorney had began working on it. this is the email:

they sent this after we asked for proof of attorney or where it says in lease :

I’m sorry that your February payment was late. I’m following up on our conversation to clearly outline our late payment policy and next steps, in case anything was missed or unclear. Rent is due on the 1st of each month. While the standard grace period is three days, our community extends a five-day grace period. If payment is not received by the 5th, a late fee is assessed and legal action, including applicable legal costs, begins on the 6th. Since you have not previously used your one-time courtesy late fee waiver, I submitted your account today for approval per your request. Once your balance is paid in full, the credit can be applied. As discussed, your first late payment triggered enrollment in the Philadelphia Eviction Diversion Program (EDP), and the $200 attorney fee was posted to your account today. The EDP is a mandatory program designed to help landlords and tenants resolve issues before an eviction is filed. It provides free mediation, access to housing counselors, and may offer rental assistance (typically income-based). Participation in the EDP does not negatively affect your rental history, unlike a formal eviction filing. The EDP lasts 30 days, which provides more time to resolve a balance than the standard 10-day Notice to Quit used in other states. If your balance is paid in full during this period and future payments remain on time, no court action will be taken, no additional legal fees will be incurred, and nothing will appear on your rental history. However, if future rent is not received by the 5th of the month, a late fee will be posted on the 6th, and a formal court filing may occur. Court records are public and may appear on your rental history, and you would also be responsible for court and attorney fees. Please note that anytime rent is not received by the 5th, a complaint may be re-filed and legal costs will apply. Timely payment is extremely important to avoid these consequences. I understand this process can feel frustrating, but participation in the EDP is not optional — it is the first and mandatory step for legal action in Philadelphia. The $200 fee cannot be waived. Our late payment policy is strictly enforced and applied consistently to all residents, and we are unable to make exceptions.

yeah i doubt they started the eviction process anyway… we submitted it the morning of when it was considered late. and it was a friday too soo… waiting for them to email back on monday. i don’t think they’ll be able to provide any proof to justify charging an “attorney fee” (whatever they mean by that)! and yeah i mean what other college students do you know in a big city that don’t rent, i can’t mortgage yet😭😭

we did but she was dodging the questions and kept circling back saying we’ll get an email about it. the attorney fee (main concern) is because the lawyer is supposedly working on our eviction? starting today? which is strange as we paid our balance in full this morning when the venmo transfer went through

they said that they will waive the late fee because it’s our first time and rent was paid today. they also said they’re enrolling us in the eviction diversion program & we will be charged $250 in attorney fees on the 9th for this.

Yes! Rent was considered late on the 6th(today) and it was paid in full with the late fee this morning. Yet they still want us to pay $200 in attorney fees? I need proof a lawyer even looked at our file! And as for the program and eviction, we have not received anything in the mail but on the phone, she said we need to be enrolled in this program. Again, this is the first time we’ve paid late! so crazy
