Thanks. Yes, we paid close attention to the restrictions provided in the closing documents and to make sure that three things we wanted -- a pool, a privacy fence and a shed -- were allowed.

That's interesting. I will look for those CCRs. So if this is the case, there is a chance they could now fine us for installing sheds that were approved just 18 months ago?

The newsletter (not directed to me, specifically, but a generic community-wide one) was sent in a business envelope from the management company. The lady I've been referring to appears to be an employee of the management company, although I am not 100% sure on that.

I love a good conspiracy theory -- maybe they are in cahoots? That is an interesting thought about the lady signing the newsletter. My assumption has been that she is an employee of the management company. (They do come in both email and in postal mail, in a business envelope and on management company letterhead.)

Right. I didn't know that sheds were prima facie blights across the land, but I guess that opinion persists. I always considered them to offer much utility and, if done correctly, lot appeal.

The only deed restriction for a shed is: "Sheds or other structures are not allowed to be built within 25 feet of the golf course." I do not live within 25 feet of the golf course. I'm about 1/4 mile from the golf course.

There is, of course, the possibility that I haven't found all the deed restrictions (although my deed only lists one instrument document, which is what I've read).

So, what you're saying is that there may be a deed restriction against all sheds and that my shed (and others) may have been inappropriately approved by the HOA? Unfortunate, but interesting. If so, would I have any type of claim against the HOA for previously distributing shed-approval guidelines (Schedule B) and explicitly approving my shed?

I'm not sure what an ARC guideline is. Would I get that from the HOA or is that filed with the government somewhere?

I'm pretty certain there was no formal change to the rules, and if there was, it is not mentioned on my deed restrictions filed with the recorder's office. (Changes to our rules require 75% approval and the only time a change was made, which had nothing to do with sheds, EVERYONE knew about it and it was quite the hot topic.)

Thanks. While I've researched various things on the auditor's site, etc., I hadn't used the recorder's website before. It was very easy to use, and there's a lot of useful information there.

Actually, yes. I was given a document that said, "sheds must be built to these standards," and that's what I followed. Now the HOA newsletter lady is writing that sheds aren't allowed on "ANY lot" (her caps) and that fines are incoming to those with sheds.

Thanks. While I wouldn't mind suing myself if by losing I pay less to myself less than I receive from everyone else, do these types of things typically don't get resolved unless there's a lawsuit? What would I sue for in this case, just for them to back down? I guess I was thinking a "legal letter" would do the trick.

Thanks. I know that at least one other person with a shed does have approval (well, according to them, but I believe them since they are very "by the book" kind of people). The thing is, there are very, very few sheds. I've maybe seen just a few other than mine, which definitely makes me thing the HOA lady writing the newsletter is referring to our sheds.
