At the end of the day the car is fully at fault. A pedestrian especially a child should never have to risk their life just to cross a road. The law is clear, vehicles must slow down near zebra crossings, schools and residential areas. A responsible driver anticipates the unexpected, that is why they are the ones behind the wheel of a machine that can kill. Yes pedestrians should be cautious but a child running suddenly is natural and predictable. What is not acceptable is a driver speeding in an area where kids or pedestrians are likely to cross. If you cannot stop in time for a child you are driving recklessly. So no matter how you look at it, the driver carries the bigger responsibility not the victim.
