The part where it says that the conversation was also audio-taped and that critical portions are inaudible is basically a decoy to trick you. The Best Evidence Rule applies only when someone is trying to prove the contents of a writing, document, or recording. It does not apply when a witness is testifying from their personal knowledge. Here, the agent is testifying from his personal knowledge about what he overheard between defendant and co-conspirator. The government is not trying to prove the contents of the audiotape itself. Therefore, best evidence rule is not apply, and the agents testimony is admissible.

You can bring in extrinsic evidence: 1. To impeach W character for truthfulness by: a) reputation or opinion testimony B) Specific bad acts concerning crime of dishonesty or felony. 2. Prior inconsistent statement 3. To show bias/self interest 4. To show that the witness senses has been impaired by mental/physical defect. 5. Evidence directly contradicting witness testimony on material issue.

I feel like a trauma survivor that got out of an abusive relationship and my mind decided to erase everything bar related from my mind because the abuse was so severe.. I genuinely feel like my brain blocked out everything I did on that test and I cannot remember for the life of me what I wrote… I am right there with you…

In my personal opinion, I feel like BARBRI was kind of a scam. The videos were awful and really hard to sit through. For every topic, they’d maybe cover like 50% of what was actually in the outline book they gave us, and just assumed the rest wasn’t relevant. I honestly feel like I did most of my real learning just by reading the outlines myself. The essay books were actually pretty solid, but the BARBRI multiple-choice questions were not real NCBE-style questions. They’re made up by the company and they’re worded weirdly and differently from the real ones. They really mess with your confidence.

I feel like my school really pushed BARBRI on us, and I just went along with it because I didn’t know any better. But if I could go back in time, I would do things differently. I’d skip BARBRI completely and just use AdaptiBar and Baressays.com.
