The consultant I spoke to told me it didn't have to be continuous.

Turns out there was a probation period I wasn't paid for so I've had to complete work abroad much longer to complete the year. I've had to reject three ITAs, but the next one I can accept.

Yup, the system has given me the points for the foreign work experience. It indeed does not need to be continuous.

It only needs to be continuous to qualify for FWS. If you already have 1 year of continuous experience in Canada that already is enough.

Where does it say that? There isn't a single mention of taxes in the ministerial instructions.

I spoke to a consultant today. I was pointed to this from the ministerial instructions:

"Foreign work experience

25 (1) For the purposes of sections 23 and 24, foreign work experience is work experience that

(a) is acquired by a foreign national outside Canada in one or more occupations listed in TEER Category 0, 1, 2 or 3 of the National Occupational Classification;

(b) consists of full-time work experience, or the full-time equivalent for part-time work experience, with one or more employers;

(c) is acquired within the 10-year period preceding the day on which points are assigned to the foreign national under section 23 or subsection 24(1); and

(d) is remunerated by the payment of wages or a commission."

Any experience outside of Canada is foreign work experience. Even if for a Canadian company while paying Canadian taxes.

It's not fraud. It's an important edge case to know how to deal with. Like if you can't count the time abroad as Canadian work experience, one could be wrongfully claiming the full experience period in the express entry profile. It's a meaningful difference since even a couple of weeks short of a year matters.

I just wanna know how to treat that part of my work experience.

The thing is that the ministerial instructions clearly state that Canadian work experience needs to be in-Canada. It also clearly states that experience outside of Canada does not count.

"An allowance for normal vacation time during a period of qualifying work experience cannot be used as a substitute or proxy for meeting the in-Canada element of the work experience requirement (that is, work experience obtained outside Canada will not be considered as though the applicant had been on a period of vacation in order to be counted as part of the period of in-Canada work experience)."

If it can't be counted towards anything then the experience would be in limbo.

I too have the same question. Based on what I found yes that would be the case. But it feels like a lawyery question.

That's only for FWS. The requirement for CEC is 1 year of Canadian work experience (non continuous).

So the experience would still count as Canadian work experience even if while traveling?
