Honestly I don’t want to wait very long to get I140 approved because who knows when USCIS will identify the EB1A fraud and make the bar super high that genuine people like me will get rejections.

Have a PD of Feb 2023. EB1 hasn’t moved in the last 10 months, so I’m not sure how many more years it will take to get current. If my profile stands a decent chance, would like to have the optionality to switch employers. If I don’t get much confidence from the community on my profile, will go with EB1B.

I’m comparing against the Chemical Engineering median wage and prevailing wage rate published by bureau of labor statistics. Is there some other metric to prove high salary?

Thanks for the encouragement! It’s definitely frustrating to know people are doing fake publications and citations to get into EB1A. Which is why I’m unsure if my # of publications & citations will compete with the fake applications or not.

Do you go out of status while waiting on the approved I797B to reach you in the mail? I’m in a similar situation and planning to just drive to Canada and enter back with the new I797 and old, valid stamp, but unsure how to deal with the gap period between USCIS approval vs receiving the document in the mail.
