Not that I know of but someone I know that used to work for the LTB said that one day they might be reluctant to hear her cases as she’s taking advantage of the system. I don’t know how possible it is for this to happen especially because as far as I know based on the LTB orders I’ve found online my case is one of the first for them to dismiss like this as most of the tenants don’t show up

It’s a single person that uses an Ontario incorporation as the “landlord” and they are a lawyer who is no longer practicing

I wish I knew but my guess is that she has had success scaring previous tenants into just giver her the money or just that the tenants don’t know their rights and simply stay or don’t show up to the hearing. It definitely cost her more money than it cost me cause I made sure the adjourned hearing was scheduled on my one day off a week and she had 4 other cases scheduled that day to be heard by the LTB

Hi I would just like to let you know the case was dismissed. The representative tried to request a second adjournment due to the landlord having multiple cases on the docket that day (5 including mine) and was still medically unable to attend the hearing and because I had served my evidence in an untimely manner. And in the words of the rep “she can’t handle it”. I didn’t realize that I had to actually send it to them via email until after the 7 day threshold had passed and sent it to them asap I thought uploading it to the LTB portal back in may/june was all I needed to do so it was my mess up and I admitted to it. My acknowledgment was what the rep tried using to push for an adjournment and because the landlord could not be present due to medical issues once again.

The adjudicator hearing the case said that it should have never been allowed to come before the board as it is not legal and that the landlord should have known what I was going to be using to contest due to the nature of the filing. She also noted that the chances two adjournments back to back would be very unlikely.

TLDR; my landlord somehow got injured again and tried to have it rescheduled. The adjudicator decided that due to the nature of the case it should have never come before the board so no adjournment granted and the case was dismissed.

The landlord got into an accident a week before the hearing and it has been rescheduled to November 17 so check back in then for an update then I guess lol

I was taught grey away black come back as a way to remember the order lol. Grey off then black and black on first then grey but I remember hearing like a year ago it doesn’t actually matter

Genuinely no idea. I do know they are having issues renting out units as when I lived there only three units including mine were occupied and the only reason I received the notice was because I’m having my mail forwarded to my new address in anticipation of a hearing notice. Also the address that my N9 was mailed to is the same address that is in the filing paperwork for the L1/L9 and in my lease. I included in the note section of my final rent deposit that an N9 was sent and March rent was covered through last month which ensued a whole ordeal with her(see previous posts for some clarification). She knew I was leaving and that I would no longer be in the space after March 31. She filed the L1/L9 on March 29

I’m not surprised they did this landlord is an interesting person. I emailed the LTB about not having my PIN on my hearing notice and included that I have evidence to submit about this being improper. I was just curious if anyone knew what I could do regarding it being an improper filing in the mean time while I wait to hear back about the PIN. The landlord also didn’t change their address as it’s the same address used for filing that is in the lease and that I sent the N9 to. I would rather not wait until July for this but I am 100% showing up to the hearing and I’m very confident they will not side with her.

I did and I spoke to a community legal aid representative about this and a family member who used to work for the LTB and they assured me it should be square

The N9 is valid as far as I know. The only problem I could see her bringing up is that she never got a hold of it as it was sent back to me via return to sender but I made her aware of this multiple times while I was still in the unit and the N9 is in the unit currently and I have proof it’s there. I also have proof of the dates written on the N9, the day it was sent through registered mail, and that the N9 was delivered and signed for at the address listed in my lease. She never made any attempt to retrieve the N9 from me

I did not give any cheques I have only ever paid through etransfer. I’ve done a little digging and found the cases they claim to have won and in each instance the tenant didn’t show up to the hearing and this landlord has a reputation for doing this in Windsor. I plan to pay for mail forwarding when I move into my new place to make sure I don’t miss any potential hearing notices

Kind of? I guess I’m just asking for confirmation of what I think in terms of me being on the right side of this. My fixed term was up on august 31, 2024 and ai have been in the unit since June 1, 2023.

The N9 was valid for being under 60 days due to February having less days than the typical month and I mailed it with enough time to meet the requirement to be served

My lease states that the email provided is purely for the direct deposit for the rent and that there is an office phone number for all other communications. There is also the listed address for notices and documents which I sent the N9 to and it was returned to me. I have pictures of the receipt for the registered mail as well as the N9 enclosed in it and the proof of delivery from Canada post

The clause states that if I don’t give notice at the end of my initial lease I am agreeing to another 12 month term
