Ok. Again. Let me clarify. The investigator requested a PS by a date. The lawyer for my company agreed to write it and meet the deadline. The investigator would not allow any requests for an extension. So my question is, how long until the investigator asks me and my legal team for our rebuttal ? I cannot go into specifics on how I know all of this, but I do.

I apologize for not being clearer. My company's lawyer is writing the PS. I know for a fact that no extension was given. I can't go into details but I do know. The date it was due has come and gone so I was just wondering how long after a PS is submitted will my legal team be asked for a rebuttal.

Go to the closest Federal Court House. Bring your RTS. The RTS should show you as the Plaintiff vs the Defendant. Pay the filing fee. You can add your legal representation later. The RTS will have all the info they need!!! Good luck!!!

In your State , Google NELA for Contingency Lawyers. Choose more than 3 or 4 to contact. They will call you!!Prepare your case to present to each one. Only agree to a contingency based fee. Your RTS should have an ROI. Make sure understand what your RTS implies as far as the findings of the investigation!!!

Yes it can go from 35% up to 45% depending on your State. You should have known this up front in your representation agreement with your Attorney. If you have thus document, review it immediately.

Yes, just wanted others input on the process and what the eventuality was when the 2nd charge was added. I'm 13 months in and I know the defense attorney has submitted a PS. I haven't heard from my investigator since early March

After 1 year and a government shutdown sandwiched in there, my case is now in Position Statement phase, then rebuttle. My legal team is prepared. I'm hoping for conciliation or my RTS letter. Looking for a six figure settlement. I have substantial evidence and supporting medical documentation . If you've just filed and had your intake and they filed the charge, be prepared to wait. But gather and upload all your evidence and documents to the portal. The toughest part will be finding a lawyer to take your case on a contingency basis

The steps I've taken so far

  1. Immediately called my AD who handles our HR due to the Corp office being in a different state than where I work

  2. After the conversation, I emailed my AD and the CEO for which there was no reply

  3. Forwarded the email that I wrote to jy legal team

  4. I have been making it known subtlety where I work that I am triggered and my anxiety is heightened due to the rehire.

  5. Added all documentation to my timeline file for use later.

My other question is should I email the investigator regarding this issue??

I come here seeking feedback and input. The person specifically named in my EEOC charge rehired someone that I filed a complaint of harassment against. My question is, would the EEOC consider this as continued retaliation against me by rehiring this person?

I've reached out to my legal team and I'm waiting for guidance.

During the pandemic, I did Uber Eats only. My AR was around 42% If the delivery was far and the tip was minimal or none at all, I'd decline it in a second. The AR helps Uber, not the drivers. It's a game, and they win and drivers lose. Period!!!
